Establishing Tienda Drive as a Through Street

RECOMMENDED ACTION: That the City Council adopt the attached resolution accepting the development improvements
for Sunwest XIV, Unit No. 1, Tract No. 2800, and amending Traffic Resolution 97-148 by
designating Tienda Drive as a through street.
BACKGROUND INFORMATION: Improvements at Sunwest XIV, Unit No. 1, Tract No. 2800, have been completed in
substantial conformance with the requirements of the Improvement Agreement between
the City of Lodi and the developers, FCF Development Associates, a California General
Partnership; Jeanne E. Paoletti, As Successor Trustee of the Chris R. Keszler and
La Veta Keszler Irrevocable Living Trust Agreement Number 3, dated December 14, 1990; A. Fred Baker and G. Camy Baker
Husband and Wife, as Community Property; and John M. Giannoni, Jr. and Kerry Giannoni, Who Acquired Title as Kerr
Giannoni and Kerri Giannoni, Husband and Wife, as Joint Tenants; as approved by the City Council on October 21, 1998, and
as shown on Drawings No. 97D068 through 97D073 and 97D098.
The subdivision contains a private 24 -inch irrigation line which extends westerly from the WID canal along the north
subdivision boundary. The terms of the Improvement Agreement stipulate that the developer shall abandon the irrigation
line, or, if the abandonment of the irrigation line has not been completed at the time of acceptance of the subdivision
improvements, the developer shall furnish improvement security of 100% of the estimated cost of the abandonment for
faithful performance for this work. The amount of the required security is $18,720. Since properties west of the Sunwest XIV
development still have rights to WID irrigation water, the irrigation line cannot be abandoned at this time. The developer has
requested that the City accept payment for this work in lieu of improvement security and assume responsibility for the future
abandonment of the irrigation line. Staff feels this is a reasonable request and recommends that Council accept the
subdivision improvements, authorize payment by the developer in the amount of $18,720 in lieu of the required improvement
security for abandonment of the irrigation line, and assume responsibility for the future irrigation line abandonment.
Staff also recommends designating Tienda Drive as a through street which will allow staff to install stop signs on the cross
streets intersecting Tienda Drive except at other higher volume streets.

RESOLUTION NO. 2000-05
A RESOLUTION OF THE LODI CITY COUNCIL
ACCEPTING THE DEVELOPMENT IMPROVEMENTS
INCLUDED IN THE IMPROVEMENT AGREEMENT FOR
SUNWEST XIV, UNIT NO. 1, TRACT NO. 2800, AND
AMENDING TRAFFIC RESOLUTION ESTABLISHING
TIENDA DRIVE AS A THROUGH STREET
The City Council of the City of Lodi finds:
1. That all requirements of the Improvement Agreement between the City of Lodi and
FCF Development Associates, a California General Partnership, Jeanne E.
Paoletti, As Successor Trustee of the Chris R. Keszler and La Veta Keszler
Irrevocable Living Trust Agreement Number 3, dated December 14, 1990; A. Fred
Baker and G. Camy Baker, Husband and Wife, as Community Property; and John
M. Giannoni, Jr. and Kerry Giannoni, Who Acquired Title as Kerr Giannoni and
Kerri Giannoni, Husband and Wife, as Joint Tenants; for the improvements in
Sunwest XIV, Unit No. 1, Tract No. 2800, have been substantially complied with.
The improvements are shown on Drawings No. 97D068, 97D073, and 97D098 on
file in the Public Works Department, and as specifically set forth in the plans and
specifications approved by the City Council on October 21, 1998.
2. The streets to be accepted are as follows:

BE IT RESOLVED that the City Council of the City of Lodi does hereby approve
the designation of Tienda Drive as a through street which will allow the installation of stop
signs on cross streets intersecting Tienda Drive except at other higher volume streets;
and
BE IT FURTHER RESOLVED, that City of Lodi Traffic Resolution No. 97-148,
Section 2(B) "Through Streets" is hereby amended by designating Tienda Drive as a
through street.

The City Council of the City of Lodi, at its meeting on Wednesday, January 19, 2000,
accepted the public improvements that were made in the subject project.
Enclosed for your files is a copy of the resolution accepting the public improvements.
From the date of the resolution, the City of Lodi will maintain the street and other public
improvements installed within rights-of-way and public utility easements as shown on
the approved plans.
The enclosed letter has been sent to your bank so the Instrument of Credit covering
faithful performance can be exonerated. The Instrument of Credit covering labor and
materials must remain in effect for a period of ninety days from the date of the
resolution, in conformance with State law. On April 18, 2000, this instrument can be
released if no claims have been filed.

correspondence regarding the release of the Instrument of Credit.
