RECOMMENDED ACTION: Adopt resolution amending Traffic Resolution No. 97-148,
Section 6, "Permit Parking," to increase Zone B permit fee from
$15 to $54 per quarter, modify the overtime parking fine from a
flat fee of $45 to $45 for first violation and an additional $45 for subsequent violations, and increase
fines for miscellaneous violations.
BACKGROUND INFORMATION:
At the January 5, 2016 Shirtsleeve meeting, staff presented
information regarding the utilization of various downtown parking
areas and provided recommendations in recovering the cost of
maintaining the parking lots.
Downtown public parking lots experience heavy usage causing wear and tear on the parking lot
pavement structure. At the January 5, 2016 Shirtsleeve meeting, staff recommended increasing the
permit parking fee to recover downtown public parking lot reconstruction and maintenance costs. City
Council directed staff to increase the permit parking fee from $15 to $54 per quarter. Staff estimates
the increase will generate $520,000 over a 20 -year period to supplement parking lot reconstruction
costs based on a 20 -year life cycle.
Staff received comments from various sources that many overtime parking violators, once cited, leave
their vehicles in the parking stall for the remainder of the day. This provides an attractive option since
violators currently receive a $45 citation for the entire day regardless of how long the violator is
parked in the stall. At the January 5, 2016 Shirtsleeve meeting, staff recommended modifying the
parking violation fine structure to discourage this practice. City Council directed staff to amend the
overtime parking fine from a $45 flat fee to $45 for the first violation and an additional $45 for
subsequent violations. A $90 maximum per day fine would apply to all day violators.
Staff recommends amending Traffic Resolution No. 97-148, Section 6, "Permit Parking", Part B, by
increasing Zone B parking permit fee from $15 to $54 per quarter. Staff also recommends approval of
the overtime parking fine amendment, and amending the parking citation as outlined in Exhibit A.
During the August 21, 2013 Council meeting, City Council adopted the resolution approving the $45
fine for the parking fine schedule. The following four violations (1) Parking on School Grounds, (2)
Unattended Vehicle Running or Parking Brake not Set, (3) Parked within 7 Feet of Railroad Tracks,

and (4) Posted Property without Permission were not included in the resolution and fine schedule.
Police Department staff recommends approving a $45 fine for the four violations noted above and
listed in Exhibit A.
FISCAL IMPACT:
Revenue associated with the increased fines and permit fees will be
directed to the General Fund. It is estimated the proposed Zone B
permit fee of $54 per quarter will generate approximately $26,000
annually towards reconstructing the downtown public parking lots.

So, here we are again writing another letter regarding the parking in downtown Lodi. I just don't understand the
thinking behind this proposal. First of all, there are way too many business owners and employees who think the
parking places for customers are their own personal parking places. Now that we finally have some enforcement again,
they are good at playing the cat and mouse game. I am for the parking fees being very high for tickets! Before when we
had none, they would leave their cars all day long. Some of the merchants do value the parking places for customers
and do purchase parking permits for the lots. And, now the City of Lodi is going to discourage people from using the lots
by increasing the fees. This makes no sense at all. There has to be another way of finding ways to pay for the upkeep of
parking lots and not punishing the people that do care and use the lots.
In August, we will be celebrating our 30 years in business mark and I am so sick and tired from having to deal with one
issue after another, especially related to parking. There are so many events that happen that shut off what parking we
do have and it makes for really bad days. For example, the pro bike tour was another joke. We had the second worse
day in our history this year. The first one being last year. I could go on and on.
I really hope that all of you will take your time to reply to this email. In the past, we have hardly gotten any responses to
our emails. Joanne has been very good at responding and I would hope the rest of you would join in. I would also be
happy to talk on the phone if you don't like to type. My cell number is 209 603-5866 and I -would welcome a call.

Now, I have an suggestion on how to come up with the money and it's a
great one!
Instead of more than doubling the fees on the people who don't care,
make the people who don't care pay. The parking tickets should be $100
for a violation, and the second violation $100, etc. If the parking officer
stayed downtown 100% of the time and didn't have to run off to
accidents, schools, etc., he/she could write more tickets. Once people
got tired of paying the high fees, maybe it would encourage them to use
the parking lots and then maybe you could increase $5-$10 gradually so
it's not so much of a jump.

This letter is submitted to Lodi City Council as public commentary in response to above referenced City
Council meeting, specifically related to Item 1.1, described as, "Adopt Resolution Amending Traffic
Resolution...".
Since May 2015, I have been tenant at a professional office located at 115 S. School Street. From my 2"
floor office window, I have an excellent vantage point overlooking School Street; which allows for
regular observation of traffic, people coming and going, engaged in commerce, running errands,
shopping, meeting for coffee, lunch, etc.
Approximately 4-6 months ago, it became obvious that the City of Lodi PD had invested in at least two
new parking enforcement officers and new vehicles required specifically for such. Prior to that, there
had been only one other officer that would be spotted occasionally working in the downtown area.
With the addition of these two new officers; it became quickly apparent that parking enforcement, at
least from my vantage point on School Street, had transformed into an aggressive revenue collection
operation.
On the matter of parking enforcement in Lodi, I offer the following for consideration:
1. There is absolutely no public safety interest in enforcing parking restrictions in the greater
downtown area.
2. The Chamber of Commerce and numerous local small business owners advertise regularly to
encourage locals and out-of-town visitors to "shop downtown"—and yet Lodi City Ordinance
and enforcement has taken a "no good deed goes unpunished" approach to parking
enforcement.
3. It is highly unreasonable to restrict parking along School Street to only 90 minutes; especially
with the number of eateries, restaurants and shops. If parking restrictions are necessary, a 3 -
hour time limit would allow for a more reasonable and leisurely experience in our downtown
district.
4. It is particularly excessive to enforce the parking ordinance on a non -working day, i.e. Saturday.
5, There are ample public safety concerns related to parking enforcement within the city limits
that better warrant the pro -active attention of Lodi PD; for example, Ed DeBenedetti Park.
Virtually every time there's a sporting event or public gathering at this location, multiple cars
parked along Century Boulevard ignore the parking restrictions and create a serious public
safety hazard by encroaching into a single lane, leaving little or no room between parked cars,
the double yellow line and oncoming traffic.
6. The less -than -convenient parking option at the ill-conceived Sacramento Street Parking
Structure requires running the gauntlet between a mostly unpatrolled structure and Sacramento
Street—not good.
The City of Lodi has recently enjoyed recent noteworthy attention about our charming downtown and
wine region. As such, we must become more welcoming to locals who would come downtown to simply
"buy local"; or to any tourist who would venture to School Street on a Friday, Saturday or Sunday to
soak -up our ambiance, spend money on food, beverage, shopping and the overall experience—NOT to
suck a punitive parking ticket.
Years ago, I saw a bumper sticker while visiting Oregon that said, "Welcome to Oregon, Now Go
Home"—the inference was for us Californians! Let's make it our purpose to avoid having non-public
safety related parking enforcement become that bumper sticker for the City of Lodi.
