Facility Digesters No. 1 and No. 2 Emergency Repairs Project

RECOMMENDED ACTION:
Accept improvements under contract for White Slough Water
Pollution Control Facility Digesters No. 1 and No. 2 Emergency
Repairs Project.
BACKGROUND INFORMATION: At the meeting on July 16, 2014, Council declared an emergency
condition to address damaged roof structures on two digesters at
the White Slough Water Pollution Control Facility, authorized the
City Manager to order required actions and execute the necessary contracts to replace the roof
structures, and appropriated $3,100,000 for the work. Western Water Construction was awarded the
contract on September 3, 2014. The contract has been completed in substantial conformance with the
plans and specifications.
The project included the replacement of existing, damaged roof structures on Digesters No. 1 and No. 2,
adding new mixing equipment to Digester No. 1, and associated work such as piping and electrical
modifications, as shown in Exhibit A.
Digester No. 2 was placed back in service on April 6, 2015. Digester No. 1 was scheduled to be
completed by August 2015. During the leak test, however, it was found that numerous small, non-
structural cracks in the digester wall needed repair. The repairs were made and Digester No. 1 was
placed back in service on January 20, 2016, the contract completion date.
The final contract price was $2,159,113. The difference between the contract amount of $1,995,710 and
the final contract price is due to one change order totaling $163,403. Change Order No. 1 includes
rerouting of primary electrical service to the facility, repair of a six-inch gas line, installation of a new
vehicle entrance gate, and coating the inside of Digester No. 1.
Since the Contractor agrees to a maximum price of $1,995,710, an allowance of $100,000 was included
in the proposal to reduce the contractor's financial risk associated with unknown structural and electrical
work. The allowance is intended to be used only on these items and any unused portion is reduced from
the contract amount. There is an unused allowance balance of $67,817 that is subtracted from the total
guaranteed maximum price contract amount to obtain the final price of $2,059,374.
The total project cost is $2,695,680, including consultant and staff time, which is $404,320 lower than the
requested appropriation of $3,100,000. It is appropriate to acknowledge the outstanding work conducted
by Western Water Constructors, Inc., the design consultant, West Yost Associates, and City staff. Due

to their effort, the City managed to complete this work substantially under original project estimates and
without any regulatory violations resulting from the digesters being out of service.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: Not applicable.
FUNDING AVAILABLE: This project was funded by Wastewater Capital (531).
