AGENDA TITLE: Accept Improvements Under Contract for Salas Park - Sports Lighting Improvements
(Phase 1)

RECOMMENDED ACTION: Accept improvements under contract for Salas Park - Sports Lighting
Improvements (Phase 1).
BACKGROUND INFORMATION: The contract was awarded to Modesto Executive Electric, Inc., of
Modesto, in the amount of $75,502, on November 18, 2015. The
contract has been completed in substantial conformance with the plans
and specifications approved by City Council.
This project consisted of removal of eight existing, 40 -foot wood light poles and installation of the City -
furnished Musco lighting fixtures and components, including eight 70 -foot steel poles and concrete
foundations, 41 lamps, pole -top assemblies, wiring, controller and monitoring system, conduit and
conductor, a switchboard panel cabinet, and other incidental and related work, as shown on the plans and
specifications for the above project (Exhibit A).
The completion date was February 17, 2016. The final contract price was $79,596. The difference between
the contract amount and the final contract price is due to unforeseen conditions resulting in the need for two
additional pull boxes; and the addition of a new panel board to provide secondary power to the concession
stand and the new lighting control panel.
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that
the project is complete and begins their 30 -day period to file a stop notice requiring the City to withhold
payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: The new lighting infrastructure will save electrical costs and reduce the City's
exposure to potential liability associated with the old, rotten wood poles that
were replaced. The second phase of this project includes replacing the
remaining lights. This phase of the project will be implemented when funding
is available.
FUNDING AVAIL B E: This project is funded by Park Capital (43299000.77020).
