Continued October 20, 1999 b) Agenda item #H-2 entitled, "Authorize the City Manager to enter into a construction agreement with Job Corps/Operating Engineers for construction of Lodi Lake Beach/West Side (undeveloped area) Trail Improvements". Parks Superintendent Dauber reported that the Lodi Lake Beach/Trail project is a two- phase project. Phase I includes the beach and Turner Road from the beach house to Mills Avenue intersection. The Job Corps/Operating Engineers have agreed to do this public service project for the City of Lodi by performing the following work: supply labor and equipment to remove the wall and sidewalk along Turner Road; remove tree root balls; grade for new trail including relocating berm and grading of beach. Value of this service is estimated to be $50,000. As part of this agreement, the City is to provide fuel for equipment, dust control, traffic control, construction staking, transportation of equipment, and design. This project is to start mid-November. Following discussion, the City Council, on motion of Council Member Pennino, Hitchcock second, unanimously adopted Resolution No. 99-165 authorizing the City Manager to sign a construction agreement with Job Corps/Operating Engineers for construction of Lodi Lake Beach/West Side Trail Project with the language regarding tree removal deleted from the agreement. 11. ORDINANCES None. 12. COMMENTS BY THE PUBLIC ON NON -AGENDA ITEMS ( -ow- a) The following people addressed the City Council expressing their concern regarding the parking of vehicles for sale on Cochran Road, which has resulted from an overflow of vehicles for sale being parked on Lower Sacramento Road: 1. Denise Sanguinetti, 2434 Summerset Court, Lodi. 2. James Coward, 2329 Wintergreen Court, Lodi. 3. Susan Leveroni, 2422 Summerset Court, Lodi. 4. Mayor Land stated that he had received a letter from a resident of the area, Dwight Ota, 2116 Wintergreen Court, which included several photographs depicting the problem. The photographs were distributed for Council's perusal. 5. A letter was also received regarding this matter from Chad Barrow, 2315 Wintergreen Court, Lodi. 6. Several persons who addressed the City Council suggested that other California cities have ordinances banning or restricting the parking of vehicles for sale on public streets. 7. Beryl Georguson, 2223 West Cochran Road, Lodi, stated that this had been tried before in the City of Lodi, but that the ordinance had been appealed and overturned. 8. Mayor Pro Tempore Mann asked that this matter be put on the agenda for the City Council meeting of November 3, 1999, including the parking of vehicles for sale on Lower Sacramento Road and Cochran Road. b) John Johnson, Orange Street, Lodi, stated that he would like to see the present boat ramp at Lodi Lake refurbished to allow handicapped people to board the City's tour boat. Mr. Johnson encouraged the City Council to look into the matter. October 17, 1999 Mr. Keith Land 511 Charleston Way Lodi, CA 95242 Dear Mr. Land, This letter is in reference to our phone conversation on Sunday, October 17, concerning the hazards caused by the cars for sale parked on Cochran Road. Over the past few months there has been an overflow of cars for sale from Lower Sacramento Road. What was initially one or two cars parked on Cochran Road six weeks ago for sale, has now grown to fifteen cars this weekend. As the enclosed photographs show, people are double parking to look at the cars, often leaving their car doors open causing a serious hazard for through traffic. The majority of these photos were taken over a twenty -minute period on Saturday, October 16, Those of us living in the Apple Orchard subdivision and our neighbors on Cochran are concerned with both the safety issues this poses and the diminishing value of our homes and properties due to the lack of consideration by the owners of the used cars. I would ask you to direct staff to immediately place signs on Cochran Road forbidding the parking of cars for sale. This problem is strictly due to the parking issue of cars for sale on Lower Sacramento Road, which has now become an even more direct problem for this neighborhood. Lower Sacramento Road should have had a total ban of used cars for sale from the start. As I mentioned, I will be unable to attend the City Council meeting on Wednesday due to a business trip, but other neighbors may be in attendance. I have also contacted all of the other City Council members, and I would greatly appreciate you sharing this letter and photos with the other members. Sinc Ch B ow 2315 Wintergreen Ct. Lodi, CA 95242 334-4685 October 25, 1999 Dear Mr. Land, I first want to thank you for presenting the photographs of the parking situation of cars for sale on Cochran Road at the city council meeting this past Wednesday night. As I mentioned, I was out of town on business that week, but a lot of my neighbors attended, speaking on both the Cochran Road and the Lower Sacramento Road problem. I understand that Cochran Road will be taken care of immediately and Lower Sacramento Road, along with a citywide issue of used car sales, will be addressed at the shirtsleeve session. The enclosed photographs are of Lower Sacramento Road between Vine Street and Tokay Street taken on this past Sunday, October 24, 1999, between 2:00 and 3:15 PM. I believe these photos will show, and leave no doubt, the seriousness of the problem as a safety issue. The photos show: 1. Double parking 2. Two adults with child crossing Lower Sac. 3. Citizens walking two and three abreast on shoulder 4. Cars crossing the intersection of Lower Sac and Cochran Rd. in the shoulder, proceeding north in shoulder to view cars for sale along Apple Orchard wall. 5. Car for sale parked in "No Parking of Vehicles for Sale" area. The public daily disregards these signs. 6. Vehicles jockeying for position to view cars for sale. 7. Police officer following car that is moving along shoulder. (I spoke with Officer Robin L'Hoir at the intersection of Lower Sac and Cochran and she stated that this is a very serious safety problem that she deals with too often.) These photos were taken in a little over one hour time span, so you can understand the dangerous conditions that exist there regularly. Incidentally, Cochran Road was the worst I have ever seen on that day. Enclosed are copies of this letter to be given to the other city council members along with one set of the photos. This is totally an issue of safety over the rights of someone to park a used car for sale. We would like to see the Cochran Road and Lower Sacramento "used car lot" immediately stopped in advance of a citywide ban discussion due to the seriousness of the safety problem. It has been luck that up to this point no serious accidents or fatalities have occurred at this location. These photographs speak for themselves. I hope the city does not continue to rely on luck. Would you please think about people parking there boats on the street. Our neighbor parked his boat on the street 91/2 days. When the city was black toping our street he put his boat on his lawn then after the street was done the next day the boat parked on the street again. My husband went to the police dept. again and we think the boat was taged Saturday. He put it on his lawn again and left his pickup hooked to the boat.
