HomeMy WebLinkAboutResolutions - No. 07-12-1909Public Hall, Lodi, California, July 12, 1909 The Board of Trustees of the City of Lodi convened in adjourned regular session pursuant to adjournment of July 6, 1909, President Geo. E. Lawrence presiding and the following members of the Board being present: J. M. Blodgett, C. A Rich and L. Villinger Absent: F. O. Hale The minutes of the previous meeting were read and approved. The following application for Building Permits were read and granted: Henry Fry, Permission to Remodel the Gatzert Building on S. Sac. St and to build a Brick Oven back of same F. A. Lattin, Addition to Barn, E. Lodi The claim of E. G. Williams of $36.30 was discussed and it appeared to be the sense of the Board That all parties renting rooms no matter how many or how few be required to pay the license tax. The Report of the City Clerk for the Fiscal Year ending June 30, 1909 was read, approved, and ordered filed. The matter of Screen Doors and lock screens for the City Hall was discussed and the necessary screening ordered done. The following Resolution was read and introduced, and upon motion regularly made by C. A. Rich seconded by J. M. Blodgett, was duly passed by the affirmative votes of J. M. Blodgett, G. E. Lawrence, C. A. Rich and L. Villinger. Noes: None, Absent: F. O. Hale Resolution of intention to Sell Bonds Whereas, it is necessary for the carrying out of the purposes set forth in Ordinance No. 33 of the City of Lodi, passed and adopted on My 25, 1908, to offer for sale and to sell certain of the bonds by said ordinance ordered to be issued as hereinafter set and therefore; Be it resolved, that it is the intention of the Board of Trustees of the City of Lodi to sell all of said municipal improvement bonds by said ordinance directed to be issued: Be it further resolved, that said bonds be had at the time and in the manner and under the conditions set forth in the following notice of sale, to -wit: Notice of Sale of Municipal Bonds of the City of Lodi, California Notice is hereby given that sealed bids or proposals will be received by the City of Lodi, California until three o'clock P.M. on Saturday, the 14th day of Aug., 1909 for the purchase of all or any portion of the following bonds of the City of Lodi to -wit: One Hundred and Twenty Sewer Bonds of the City of Lodi, numbered consecutively from one to one hundred and twenty, divided into thirty series of four bonds to each 213 series, the series numbered consecutively from one to thirty; said bonds are thirty year serials: one bond in each series is for one hundred and sixty-six and two-thirds dollars, and three bonds in each series are for five hundred dollars each; all of said bonds are dated July 1St, 1908; all of said bonds bear interest at the rate of five per cent (5%) per annum, payable semi annually on the first day of January and the first day of July of each year, principal and interest payable at the office of the Treasurer of the City of Lodi: one of said one hundred and sixty-six and two third dollar bonds and three of said five hundred dollar bonds are due and payable on the first day of July of each and every year until all are paid. One Hundred and Fifty Water and Light bonds of the City of Lodi, numbered consecutively from one to one hundred and fifty, divided into thirty series of five bonds to each series, the series numbered consecutively from one to thirty; said bonds are thirty year serials: and bond in each series is for five hundred and thirty three and one third dollars, and four bonds in each series fare for five hundred dollars each; all of said bonds are dated July 1St. 1908" all of said bonds bear interest at the rate of five per cent (5%) per annum; payable semi-annually on July 1St of each year, principal and interest payable at the office of the Treasurer of the City of Lodi; one of said five hundred and thirty—three And one third dollar bonds and four of said five hundred dollar bonds are due and payable on the first day of July, 1909, and one of said five hundred and thirty and one third dollar bonds and four of said five hundred dollar bonds are due and payable on the first day of July of each and every year thereafter until all are paid. Said Bonds are issued under the authority of an Act of the Legislature of the State of California, entitled, "An Act Authorizing the Incurring of Indebtedness By Cities, Towns and Municipal Improvements and Regulating the Acquisition, Construction and Completion Thereof," which became a law under constitutional provision without the Governor's approval, February 25th, 1901. No bids or proposals for said bonds will be entertained at less than their face value, together with the accrued interest at the date of their delivery, and all bids or proposals submitted will be construed by the Board of Trustees to mean par and accrued interest to date of delivery of said bonds in addition to the premium offered, whether the bids or proposals set forth the same explicitly or not. The said bonds are now ready for delivery and will be delivered at the said Treasurer's office in the City of Lodi, or at any designated place, upon the payment by the purchaser of all the expenses incurred in the delivery of the bonds and transfer of the money necessary to make delivery and payment equivalent to a transaction at the office of the City Treasurer of the City of Lodi. All bids or proposals providing for delivery at any place other than the said Treasurer's office or the City of Lodi, will be construed by said Board of Trustees to mean the price bid in addition to the expense of delivery, whether the bids set forth the same explicitly or not. Each proposal or bid should be enclosed in a sealed envelope addressed to the City Clerk of the City of Lodi, and endorsed "Proposal for Bonds;" each bid or proposal will be 214 deemed to be absolute and unconditional, whether so stated or not, and with each bid or proposal must be submitted a certified check drawn upon some responsible bank of the State of California, and payable to the order of the Treasurer of the City of Lodi, for two per cent (2%) of the face value of the bonds for which said bid or proposal in made, as a guarantee that the successful bidder will take up and pay for said bonds in accordance with this bid, within twenty days after said Board of Trustees shall have passed a resolution awarding said bonds to said Bidder, and said check and the amount represented thereby will be forfeited to the said City on the failure of such successful bidder so to take up and pay for said bonds in the event the bid or proposal is accepted. Said Board of Trustees reserves the right to reject any or all bids or proposals and to waive any informality in any bid, as the interest of the City my require.
