HomeMy WebLinkAboutResolutions - No. 07-01-1918cdiaggran thereof, whereupon said Clerk gave notice of the filing of said list and fixed in said notice Yonday, the 13t day of Tuly, 1918, at the hour of E o'clock P.m. at the regular meeting place of said Board of Trustees, towit the Cour_cil Chambers of the Board of Trustees, in the City :fall of said City of Lodi, as the time and place, respectively, when and where interested pars ons might appear before said Board of Trustees and s oar cause why bonds should not be issued upon the security of the unpaid assessments shown on said list, said time being that of a regular meetir.8 of said Baord; and WHEREAS, it satisfactorily appears from the affidavits produced that the Clerk of this Board has caused to be given due notice by post— inti and publication as required by law of the filing by the Superinten— dent of Streets of the list of all unpaid assessments made under said Resolution of Intention No. 14, of. said City; and WHEREAS, it has been found that since the filing of the afore— said list or unpaid assessments the following assessments have been fully paid to the proper officer of said City, towit: Assessments numbered 30 and 31, aggregating the total amount Of $856.65, leaving a balance due on account of said unpaid assessments of $2,586.95; and 'J,MREAS, no protests or objections were presented or filed against the issuance of bands, as aforesaid, before or at the time set for said hearing, and no particular cause having been recorded why, bonds should rot be issued upon the security of said unpaid assessments, aggre— gating the total sum of $2.566.95, and it further appearing that said list of unpaid assessments filed by the Superintendent of Streets is in all respects complete and correct, excepting therefrom the assessments paid since the filing of the said list as hereinbefore set forth; BE IT RESOLVED: that said list of unpaid assessments as filed by the Superintendent of Streets was in all respects complete and correct at the time of filing, and that since said time Assessments numbered 30 and 31 have been paid, and the Board hereby finds and determines that the unpaid assessments ;Wade pursuant to the proceedings taken under said RQsolution of Intention No. 14, and the aggregate amount of the same, are as follows: Owner. RESOLUTION No. 20, _ Providir_g For the Issuance of Improvement Ponds to Represent and Be Se— cured by Assessments Made For the Cost of the Work and Improve— rents Made it and Upon West Oak Street, from the East Line of School Street to the East Line of h'utchins Street, in the City of Lodi, California, and to Provide for the Sale Thereof. BE IT RESOLVED, by the Board Of Trustees of the City of Lodi, California, as follows: Vr-I:,RFAS, this Board of Trustees by its Resolution of Intention No. 14, providing for the improvement of the roadway on west Oak Street, from the east line of School street to the east line of Hutchins Street, determined that serial bonds to represent unpaid assessments and to bear Interest at the rate of seven per cent. per annum, would be issued there— under in the manner provided by the 9lmprovemen t Bond Act of 19159 and that the last installment of which bonds should mature nine (9) years from the 2d day of Tuly next succeeding rine months from their date, and 7 R=AS ,the Rork to be done under said Resolution of Intention No. 14 has been completed to the satisfaction of the Superintendent of Streets, and of the Board of Trustees; and the Superintendent of Streets on the 19th day of Tune, 1915, filed with the Clerk of the Board of 7.`rus-- tees a completa list of all unpaid assessments made_ under said proceed- ings; and 17MREAS, this Board of Trustees has this day found and determined that the aggregate amount of said unpaid assessments is the Sum of '12 586.9-5; NOW, THEREFORE, BE IT RESOLVED, as follows: Street Improvement Bonds, to be issued pursuant to the provisions of the "Improvement Bond Act of 191511, evidencing the aforesaid indebt- edness, shall be issued to the aggregate amount of $2,566.95, and the number, denomination and character of such bonds shall be as follows: Said bonds shall be dated tae Ist day of Tuly, 1916, and shall be of tha character icnown as sQria.Is. If a satisfactory bid be received, the successful bidder may be allowed ten days for examination of the proceedings authorizing the issue of said bonds, and may make 'res bid subject to the legality of said proceed- ings. Monday, July 22d, 1918. Such bids shall be ad- dressed to the undersigned and must be for not less t'r_an par value of the bonds bid for, with accrued interest to date of delivery. The right is reserved to reject any and all bids. The successful bidder will be allowed ten days for examination of the proceedings, and bids may be ?:lade subject to the legality of the proceedings. Each bid must be accomparlPd by a certified check or cashier's check upon some re- sponsible bank, in a sum equal to ten per cent of the par value of the bonds bid for. Said checks shall be made payable to the undersigned. Said issue of bonds aggregate the total sum of $2,586.95,bgar- ing interest at the rate of seven per cent per annum, payable semi-an- nually on the 2nd days of January and July of each year. Said bonds are of the following denominations: Ten of $200.00 each; and Ten of $58.69 each, and are dated July 1st, 1918. Said bonds are of the character known as serials, and one bond of the par value of $200.00 and one bond of the par value of $58.69 are payable annually from July 2nd, 1919, to July 2nd, 1928, both inclusive, and are issued pursuant to the provisions of the street improvement bond act of 1915, and pur- suant to proceedings taken by the Board of Trustees of the City of Lodi, under Resolution of IntQntior_ 'Yo. 1+. Absent: Trustee Crose. The City Attorney was directed to prepare a resolution appro- priating 4900 to the Lodi Library, to be payable in monthly install- !nents of 175.00. ORDINANCE NO. 100, "An Ordinance Amending Section 2 of Ordinance No. 38, as Amended by Ordinances Nos. 89 and 92," having been introduced June 24th and laid on the table for not less than five days, coming up for final read- ing, :rs upon motion of Trustee Keeney, seconded by Trustee Montgomery, adopted by the following vote: Ayes: Trustees Keeney, Montgomery, Hale and Black. Noes : None. Absent: Trustee Cross. ORDINANCE NO. 101, "An Ordinance Pertaining to and Providing for Limiting and Reg- ulating the Selling, Furnishing, Serving or Giving Away or in any Man- ner Disposing of, Either Directly or Indirectly, of any Spirituous, Vinous, Malt, Mixed, Fermented, Distilled, Alcoholic or Any Intoxicat- ing 'Liquors Within the Corporate Limits of the City of Lodi, and Re- pealir_g All Parts of Ordinances in Conflict Herewith, and ?roviding a Penalty for any Violation of this Ordinar-e ," was read and Intro- duced for passage and upon motion was laid upon the table for not less than five days. J. E. Bishop was granted permission to move and remodel a build- ing on the north i of lots 3 and q in block 8, City of Lodi. The City 1arshal's report for the month of Tune was read and ordered filed.
