A3SENT: Trustees, None. RESOLUTION OF INTENTION N0.64. R33OLY J,That the public interest and convenience require, and it is the intention of the Board of Trustees and City Council of the City of Lodi to order the following work to be done and the following improvement to be made in said City, to -wit: That a public street shall be opened between the north line of Loekeford Street, in said City, and the south line of Daisy Avenue, in said City, said street to be sixty feet in width and to lie thirty feet upon each side of a certain line, which is described as that part of the west line of Section 1, Townshipt 3 Borth, Range 6 Last, ;:.D.B.& !:.,Lying between the said north line of Loekeford Street and the said south line of Daisy Avenue in said City; the line so described being the center line of the street so to be opened. Excepting that part of said sixty foot strip of land which lies within the right of way of the San Joaquin and Sierra Nevada Rail Road, being the railway line running from Lodi to Woodbridge in the County of San Joaquin. The land necessary to be taken therefor is partic- ularly described and bounded as follows, to -wit: That certain strip of land sixty feet in width bounded on the south by the north line of said Loekeford Street, on the north by the south line of said Daisy Avenue and lying thirty feet on each side of the center line of said street so to be opened, as above described, except that part of said land lying within said railroad right of way. The exterior boundaries of the district of lands to be affected and benefitted by said work and improvement, and to be assessed to pay the damages, cost, and expenses thereof are as follows: All that certain district and lands lying within the corporate limits of said City of Lodi, County of San Joaquin, State of California, and particularly described as follows: Com,naneing for the same at the intersection of the center line of Lincoln Avenue rdth the South line of Forrest Avenue (formerly Woodbridge Avenue) in the City of Lodi,Calif- orni6, and running thence south on and along the said center line and its southerly production to the intersection of said production with the north line of Lookeford Street; thence westerly on and along the north line of Loekeford Street to its intersection with the west boundary of the corporate limits of said City; thence north on and along said west boundary line to its intersection with the south line of Forrest Avenue; thence east on and along said south line of Forrest avenue to the point of beginning. Provided,nevertheless, that the railway line, and railway right of wap, streets, avenues and alleyssituated within said district shall be omitted from any assessment made or levied to pay the damages,cost and expenses of the above men- tioned work and improvement, the said streets,avenues and alleys belonging to said city, and being in use for the perfor- mance of a public function, to -wit, in use as public streets, avenues and alleys. The Lodi News is hereby designated as a tri -weekly newspaper published and circulated in said City in which the Street Superintendent's notice of the passage of this resolution shall be published, there being no daily newspaper and no weekly k 6 newspaper and no semi-weekly newspaper printed or published in said City, and it is hereby ordered that said superintendent's notice be published in the newspaper so designated, three times a creek for at least four successive weeks, and said street superintendent shall post said notice as required by law. ------000------------- CCTf.M_ TICATI0173: The Clerk read letters from the following: A letter in answer to one written asking cost of the serv- ices of an engineer from the State Railroad Commission to invest- igate power rates, stating that a representative of the commission would call upon the Board shortly; ' An invitation from the rodeo association at Livermore inv- iting the Board to be present; A letter from Division Superintendent C.F,.Gaylord of the S.P.Company enclosing copy of bulletin asking engineers to use minimum of whistling in the city, Report for the past year of the Lodi Volunteer Fire i Department enclosing equipment inventory submitted by the sec- retary Wm. H. Faust; Report of the Fire Chief of activities of the department during the past year; A proposition from the Trustees of Lodi Lodge No.41 K of P tendering their lot on West Pine at a price stated therein, for a City Hall site; A letter from ilarwick,rlitchell & Gompany, public account- ants in rezard to an annual audit. All the above were ordered filed without further action. on motion of Trustee Mettler, seconded by Trustee Hickok, the Clerk was directed to advertise for the annual printing.
