The following resolution ordering the work on '.ain Street
-as then introduced by Trustee Rich, seconded by Trustee Hickok: -

Resolved, that whereas the Board of Trustees of the City
of Lodi, did on the 5th. day of April. A.D.1921, pass its Resol-
ution of Intention No. 31 to order the hereinafter described work
to be done and improvement to be made in said City, which Resol-
ution of Intention ..as duly and legally published as required by law
as appears from the affidavit of pnblication in t"he LODI 3 TINEEI

of said City of Lodi; and

front of all the property liable to be assessed therefore, and on
each and every street and high,vay in the assessment district des-
cribed in said Resolution of Intention, in time, form, manner and
ri.:.:ber as required by law, after the passage of said Resolution of
Intention , as aLDears from the affidavit of 2.3.1cClure, who person-
ally posted the same, and who, upon the completion of the posting
of said notices, filed said affidavit in the office of the said
City Clerk, making oath that he completed the posting of said notices
on the 7th. day of April A.D. 1521 ; and

posed of in time, form and manner as required by law,. the Board of
Trustees raving found that said protests were made by the oMers
Of less than one-half of the area --of the property to be assessed
for said improvements, and said board having now acquired juris-
diction to order the proposed im-provement, it is hereby, -
RESOLVED, that the rublie interest and convenience require the
work herein described and the Board of Trustees of the City of
Lodi hereby order the folloring work to be done and the improve-
ment to be glade in said city, to wit: -
That Main Street. In said City, from
the south line of Lockeford Street to
the north line of Locust Street, and
from the south line of Locust Street
to the north line of Elm Street, and
from the south line of Elm Street to
the north line of Pine Street, and
from the south line of Pine Street to
the north line of Oak Street, and
from the south line of Oak Street to
the north line of Walnut Street, and
from the south line of Walnut Street
to the north line of Lodi Avenue BE
IMPROVED:
(1) By grading all portions of said
Main Street upon which work is to
be done and improvement made.
(2) By constructing hydraulic con-
crete curb and gutter along the east
side of the roadway of said Main
Street.
(3) By constructing a gutter fif.
teen (15) inches wide along the west
side of the roadway of said Main
Street. having an hydraulic concrete
foundation four (4) inches thick cov.
ered by an asphaltic concrete wearing
surface one and one-half (Ili) inches
thick.
(4) By paying the roadway of said
ylain Street between the gutter lines
with an asphaltic concrete pavement
consisting of an asphaltic concrete
wearing surface one and one-half
(1%) laches thick laid on an asphal-
tic concrete foundation three (3)
inches thick.
(5) By constructing a sidewalk on
the sidewalk area along the west
side of said Slain Street from the
south line of Elm Street to the north
line Pine Street, and from the south
line of Pine Street to the north line
of Oak Street, and from the south line
of Oak Street to the north line of
Walnut Street, consisting of an
asphaltic concrete wearing surface
one and one-half (15th) inches thick
laid on the following foundation, to -
wit; For a strip fifteen (15) Inches in
width adjacent to the curb line said
foundation shall be of hydraulic con-
crete four (4) inches thick, and for
the remainder of the sidewalk area
tite foundation shall be of asphaltiz
concrete three (3) inches thick.
(6) By constructing an hydraulic
concrete sidewalk four (4) inches in
thickness on the sidewalk area along
the east side of said Main Street as
liereinbefore described; said sidewalk
constructed in front of blocks Num-
bered 25, 29 and 30 In said City of
Lodi shall have a width of 5 feet:
and said sidewalk constructed In front
of blocks Numbered 26, 27 and 28 in
said City of Lodi shall have a width
of seven and one-half (74) feet.
EXCEPTING, howe?or, from all of
the hereinabove described work,
such portion as is required by law to
be kept In order or repair by Say
person or company having railroad
tracks thereon; and excepting also
from all of the bereinabove described
work, any of said work already done
to the official grade.
All of said work shall be done in
accordance with the plans and spe-
cifications heretofore adopted for do -
jug said work and now, on file in the
office of the City Clerk
Excepting,howaver,_from all tae hereinbefore described work,
such portion as is required by law to be kept in order and repair
by any person or company having railroad tracks thereon; and
excepting also fro= L11 the hereinbefore described work any of said
work already done to the official grade.
All of said work shall be done in accordance with the plans
and spacifications heretofore adopted for doing said work and now
on file in the office of the City Clerk, and where certain work
proposed to be done on the respective streets, avenues and high-
ways aforementioned, is described as being between wertain lines,
it includes the doing of all such work upon the street intersect-
ions and terminations between such lines, unless otherwise shown on
the plans; providing, homraver, that any duplication in such descript-
ion shall be ignored; and
W? RLAS, said contemplated ,cork and improvement, in the opinion
of the Board of Trustees, is of more than local or ordinary public
benefit, said board 'hereby makes the expense of said work or improv-
ement, chargeable upon a district, which district said Board here-
by declares to be the district benefited by said work and improv-
ement, and to be assessed to pay the cost and expenses thereof; which
said district is bounded and described as follows: -
Commencing at a point where the
west line of Block 24 of the City of
Lodi produced southerly intersects
the north line of Lodi Avenue, and
running thence northerly in a
straight line to the northwest corner
of Lot 1, in Block 22; running thence
easterly to the northeast corner of
Lot 2, In Block 30; running thence
southerly to the southeast corner of
Lot 7. in Block 29; thence southerly
to the northeast corner of Lot 1, in
Block 28; thence southerly to the
southeast corner of Lot 12. in Block
26; thence southerly to the northeast
corner of Lot 2. In Block 25; thence
southerly to the southeast corner of
Lot 7, In Block 25; thence westerly in
a straight line to the point of begin-
ning; all as said lots and blocks are
shown on the official map or plat of
said City of Lodi: -

provided, nevertheless, that the streets, avenues and alleys
situate within said district shall be -omitted from any assessment
made or levied for paying the costs and expenses of the above ment-
ioned work and ir.provement, the said streets, avenues and alleys
belonging to said city, and being in use for the performance of
a public function, to wit, in use as public streets, avenues and
alleys.
tnd it is further ordered and notice is hereby given, that
serial bonds to represent unpaid assessments, and bear interest at
the rate of seven per cent(7 ) per annum, will be issued hereunder
in the manner provided by the Improvement Act of 1915, and Acts
Amezldatory thereto, the last installment of which bonds shall mature
nine years from the 2nd. day of July, next succeeding nine months
from their date.
The City Clerk is hereby directed to post a notice of said
work, together with plans and specifications therefore, conspic-
uously for five days on or near the council chamber door, inviting
sealed proposals or bids for doing the work ordered. He is also
directed to'publish three times a notice inviting such proposals
and referring to the specifications posted or on file, in the LODI
SE-NITINEL, a tri -weekly newspaper published and circulated in said
City of Lo -i, and hereby designated for the purpose, said paper
being the official newspaper of the said City of Lodi.
The foregoing resolution No.131 was thereupon adopted by the
following vote, to -wit:
Ayes, Trustees, Rich, Hickok, Grose, Hale and I.ontgomery.
Noes, Trustees, loon.
Absent, Trustees, None.
This being the date set by motion and stated in advertisement
published for the receivig of bids for mater pipe, valves, fittings
and hydrants, the Board proceeded to open and canvass the bids
received; proposals from the following named companies were found
to be in proper order and accompanied by the required deposit:-

Owing to the technical nature of the matters involved, it was
decided to postpone action on the above proposals to a later date
such date being set at 1.30 P.Y. on April 26-1921
John Thomas Guilfoyle appeared before the board and applied
for pe=�-,ission on behalf of Lodi Post of the American Legion to
hold an exhibition of fire -works at Laarence Park. Decision in
this matter was postponed to Apr.26th. in order to consult with
the fire chief.
The a»pl;cation of the Lcdi Lumber Company for permission
to run a -spur track to its sheds on Lockeford and Mair_ Streets
from the Valley Springs branch of the Southern Pacific Company
was granted, it being shorn that the entire length of the spur
Toaid be on property of the rail -road company and of the petit-
ioner; permission to be conditional on the company accepting the
insertion of the following clause in the letter grpnting such

At the order of the board, the clerk was instructed to have
the premises at the S.N.Corner of Locheford Street and Pleasant
Avenue inspected by the Fire Chief as complaint had been filed
that the partly destroyed building thereon is a menace to ptblic
safety.
