HomeMy WebLinkAboutResolutions - No. 03-30-1925Minutes' 119 Cit yy hall, Cityy of Lodi Mfonday, larch 3O - 1925 The Board of Trustees of the City of Lodi net in adjourn- ed regular session at 8 o'clock P.M. on the above date, Trustees Hale, Mettler, Roach, Shattuck and Spooner present, none absent. The minutes .of the regular meeting of Yarch 16th,1925 were read, approved as read and so endorsed by the 'President. This _being -the date set by Resolution No. 475 passed march 16th., for the hearing of protests against the opening of Hutchins Street as undertaken pursuant to Resolution of Intent- ion No. 474, adopted January 19th..1925, and it appearing on affidavit of the Clerk that notice of the time- and place of hearing had been duly mailed to the several objectors, the boaxd proceeded to consider the merit of the objections advanced. Attorney J.M.McMahon addressed the Board in support of the written objections advanced and advocated the opening of California Street southerly .in lieu of the proposed work. No further persons addressing the Board, Trustee Hale, seconded by Trustee Shattuck introduced Resolution No. 476 and the same was passed and adopted by the following -vote: - AYES: Trustees, Hale, Shattuck, Mettler, Roach and Spooner. NOES: Trustees, None. ABSENT: Trustees, None, R.:SOLUTION-NO, 476 RESOLUTION OVERRULING ALLEGED OBJECTIONS TO WORK OR =0V UNDER RESOLUTION OF INTENTION NO. 474. IJP" R :AAS t on the 19th da of Janun 1925, the Board of Trustees and City Council of the City oof Lodi, San Joaquin Countyy California., duly passed and adopted Resolution of Intention Mo.474; and whereas notices of the pass a of said resolution have been posted, given and publidhedyin ail respects as re aired by law and in all respects as required by said Resolution of retention; and whereas on March 12th.,1925, more than ten days since the com- 3etion of the publication of said notices, John H. Corell zm.H.lLenzel,Andrew Kut�ick:am.Core11 Thomas Huron and F Raria.tocacci filed with the Clerk of said toard their alleged written objections to the work andimprovement mentioned in said Resolution of Intention and to all matters therein contained; and whereas no written objections and no objections whateverhave been made within ten days since the completion of the publication of said notices, which time of publication expired on February 27th, 1925; and whereas said Board of Trustees did on 'March 16th.,1925, and without waiving the fact that said alleged written objections of said pprotestants and objectioners were not filed within the time allowed by law, fix a time, to -wit, March 30th.,1925 at eight o'clock in the afternoon forhearing said alle~ed objections- and whereas the said City Clerk thereupon notified the said protestants andob'ectioners of the time fixed dor the hearing of their alleeg�ed objections, b depositing a notice thereof in the Post Office of said City with postage prepaid, addressed to eachof said ob'ect- ioners;anA said alleged objections coning on duly and regulas-Iy to be heard at the time specified in said notice to -wit, at eight o'clock in the afternoon on March 30th.,1925; anti said Board 190 havinngg fully heard the same and all evidence and matters sub- nitted in support thereof - BE 1T RESOLVED: Thai said alleged objections of said pro- testants and objectioners and the whole thereof are without merit and said alleged objections and each and all thereof are hereby overruled. BE TT FURTHER RESOLVM: That although the said Board of Trustees has heard and decided said alleged objections upon their merits, said Board and City Council has not and does not waive the fact that said alleged objections of said protestants were not filed within the time allowed by law. The Clerk read a letter from the local V.C.T.U, thanking the Board for their enforcement of the "Curfew Ordinance" The application of Angelo Palermo for permission to inst- all a as siv�aa in front of his ice-cream factory at Oak and Garfield Streeis with the interior side above the side -walk grade vias referred to the City .Planning Commission on motion of Trustee Shattuck. Clyde S. Jackson submitted a verbal, proposal to establish a traffic squad in the City under the supervision of the City Marshal this service to be in connection with similar service in the 6ity of Trac and to cover the services of a mounted trafic officer for three daps per week at $10.00 per day. it was decided, tentatively, that the Board zmcbix providing that the City of Tracy adopted this service, mqc would employ Mr Jackson for a trial period of three months. Supt. of Public Utilities, J.A.Henning, submitted a let- ter received by him from Mr H.D.Miller of the 'western States Gas & Electric Company wherein his Company set a price of $614.47 on their power transmission line to the City's pump on the Sanguinetti place; thisrice included six poles, wire, fixtures, cross arms 3 - 3 KW 390-4400 volt transformersri cut-outa-and meter. trustee Shattuck stated that he had person- ally viewed the line and thought the price in excess of re- placement cost and on his motion, seconded by Trustee Mettler, the.Clerkwas directed to submit. the Company an offer of $4450 for the line subject to acceptance on or before April 20th.,1925. flour building permits at a total estimated cost of $2 250.00 were allowed, The application of Yee Lee to build a frame §area at #212-N.
