A RESOLUTION OF THE LODI CITY COUNCIL CERTIFYING THE
FINAL MITIGATED NEGATIVE DECLARATION AND ADOPTING
MITIGATION MONITORING AND REPORTING PROGRAM FOR THE
CITY OF LODI WHITE SLOUGH WATER POLLUTION CONTROL
FACILITY STORAGE EXPANSION AND SURFACE, AGRICULTURAL,
AND GROUNDWATER SUPPLY IMPROVEMENT PROJECT; STATE
CLEARING HOUSE NO. 2017012035
WHEREAS, the City Council of the City of Lodi has held a noticed public hearing, as
required by law, on the requested project environmental document in accordance with
Government Code sections 65090, 65091, and 65094; and
WHEREAS, the project proponent is the City of Lodi; and
WHEREAS, the project is located at the White Slough Water Pollution Control Facility in
unincorporated northern San Joaquin County and to the west of the City of Lodi; and
WHEREAS, an Initial Study/Mitigated Negative Declaration (File No. 2017-02 ND) was
prepared in compliance with the California Environmental Quality Act (CEQA) of 1970, as
amended, and the Guidelines provided thereunder. The Community Development Department
has determined that all environmental impacts that result from this project can be mitigated to a
less than significant level; and
WHEREAS, on January 14, 2017, the Notice of Completion of the Draft Initial
Study/Mitigated Negative Declaration was prepared and distributed to the State Clearing House,
reviewing agencies, responsible agencies, trustee agencies, and the county clerk in which the
project is located, as well as all persons requesting notice; and
WHEREAS, the Notice of Availability for the proposed Mitigated Negative Declaration
was published in the Lodi News Sentinel on January 14, 2017; and
WHEREAS, on January 13, 2017, the Notice of Availability of the Draft Initial
Study/Mitigated Negative Declaration was distributed to property owners within 1,000 feet of the
project boundary; and
WHEREAS, the required 30 -day review period for this project commenced on
Saturday, January 14, 2017, and ended on Wednesday, February 15, 2017; and
WHEREAS, the City received seven comments during the public review period and
the comments were responded to and incorporated into the Final Mitigated Negative
Declaration; and
WHEREAS, on March 15, 2017, the City Council of the City of Lodi held a noticed
public hearing to consider certification of the Final Mitigated Negative Declaration (2017-02 ND)
and associated Mitigation Monitoring and Reporting Program as adequate environmental
documentation for the project pursuant to CEQA; and
WHEREAS, on March 15, 2017, the City Council of the City of Lodi considered all oral
and written comments received at or prior to the public hearing on the matter and has
determined that the Final Mitigated Negative Declaration (2017-02 ND) and associated
Mitigation Monitoring and Reporting Program are adequate environmental documentation for
the project; and
WHEREAS, staff recommends that the City Council approve the filing of a Mitigated
Negative Declaration by the Community Development Director as adequate environmental.
documentation for the. City. of Lodi White Slough Water Pollution Control Facility Storage
Expansion and Surface, Agricultural, and Groundwater Supply Improvement Project; and
WHEREAS, all legal prerequisites to the approval of this request have occurred.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council has reviewed all
documentation and hereby adopts the Final Mitigated Negative Declaration and associated
Mitigation Monitoring and Reporting Program as adequate environmental documentation for the
City of Lodi White Slough Water Pollution Control Facility Storage Expansion and Surface,
Agricultural, and Groundwater Supply Improvement Project.
