AGENDA TITLE: Report Regarding The Advisory Board 49-99 Library Systems

BACKGROUND INFORMATION: The purpose of this report is to provide the City Council with an update on the
Advisory Board 49-99 Library Systems. According to a memorandum by the
Deputy City Attorney (copy attached), the responsibility and management of
the Advisory Board 49-99 Library Systems may be transferred to the Library
Board of Trustees. Pursuant to this suggestion, a letter was sent to the President of the Library Board of Trustees
notifying him that this transfer would take place immediately.

RE: Appointments to 49-99 Advisory Board.
Question: May the City Council delegate to the Library Board the task of selecting the citizen
representative to the 49-99 Advisory Board?
Answer: Yes, but this board may be changing its composition or ceasing its existence over the next few
years as the Library of California Act is phased in.
Analysis: Under the California Library Services Act [Education Code §§ 18700, et seq.] there is created
a mechanism for various individual libraries to consolidate into a library system. This consolidation may
take various forms and include various components of service (i.e., materials sharing, systemwide
services evaluation and planning, etc.].
The city currently is involved in such a library system which I will refer to as the 49-99 system. Under
the Education Code the system must have an administrative council consisting of the head librarians of
the various member jurisdictions and a citizen advisory board. [Ed. Code § 18747] Appointments to the
advisory board are to made by the governing body of each member jurisdiction from among its residents.

I see no reason why the council could not delegate the recruitment process to the Library Board. This
process would then culminate in a council appointment based on the recommendation of the Library
board. Such an arrangement would bring council involvement to its absolute minimum and place the
burden of performing the work upon the persons most qualified for, and dedicated to, the task.
It should be noted that this entire issue may become moot over the next few years as the Library of
California Act is phased in. This recent legislation does not provide for a citizen advisory board. Thus,
it appears that the 49-99 board will either cease to exist entirely or be reconstituted in some way as part
of the transition process.

This letter will confirm the action of the Lodi City Council at its meeting of July 7,
1999 in regards to the Advisory Board 49-99 Library System.
Effective immediately the responsibility and management of the Advisory Board
49-99 Library Systems will be under the direction of the Library Board of Trustees.
