JOHNSTON 1986 JAN 15 AN II: 34 RECORDED AT REQUEST OF _CITY SHOWN ORDER VACATING PARCELS A & B JOAQUIN PARK, TRACT 1010 FEE -71!XEMPTIROM FEE THE CITY COUNCIL OF THE CITY OF LODI FINDS: That on August 30, 1973 there was an offer of dedication for street purposes of Parcel "A" and Parcel "B" of Joaquin Park, Tract 1010, Lodi, and filed for record in Book of Maps and Plats in Volume 20, Page 52, San Joaquin County Records. That the parcels have not been used for the purpose of extending Whitney Street, but have been used for the extension of utilities and that said described parcels are not necessary for the future extension of Whitney Street. WHEREAS, pursuant to provisions of Section 8333, et seq, of the Government Code of the State of California, the matters referred to the Planning Commission, a Resolution of Intention to Vacate was adopted setting the matter of public hearing, and the City Clerk uvea directed to publish and post such notice of public hearing in the manner and form required by law. NOW, TT EREFORE, pursuant to the foregoing findings and under the authority of Section 8300, et seq, of the Streets and Highway Code of the State of California, it is ordered that there is hereby abandoned and vacated Parcels "A" and "B" and RESERVING however and excepting from this vacation, the permanent easement and the right therein to construct, maintain, repair and operate lines for public utilities, both publicly and privately owned, in, over, and across said Parcels "A" and . The City Manages and City Clerk are hereby authorized to execute, on behalf of the City, a Quitclaim Deed to the appropriate persons.
