HomeMy WebLinkAboutResolutions - No. 083-06oN zu.e/9 p4iUJ� 71r4e,gsa�b • Order No. 083-06 ORDER VACATING AN ALLEY NmH OP LOUIE AVENUE BETWEEN CALIFORNIA aiitr l AND LINCOLN AVENUE, LODI , CALIFORNIA JAMES !•'1 ,'' _ �,-,' 1584 JU3 -5 AM K) 03 RECORDED ,,3 FEOUEST Or anf mom_ EEE _EXEMPT -FROM _EXEMPT - FE WfS, this City Council, acting in accordance with provisions of Part III of Division 9 of the Streets and Highways Code of this state, did on the sixteenth day of May, 1984 pass and adopt a Resolution of Intention No. 84-045 therein declaring the intention of said City Council tb vacate an alley north of Louie Avenue, between California Street and Lincoln Avenue, Lodi, California, County of San Joaquin, State of California, and more particularly described as follows, to wit: the alley located north of Louie Avenue, between California Street and Lincoln Avenue , Lodi , Cali fornia with the following conditions: a) that a public utility easement be retained in the area occupied by utility company and city facilities; and b) that a 3 foot easement be acquired along the south line of the alley to provide for existing a m on utility poles. WHEREAS, notice of said intended vacation was regularly given by publication and by posting, both in time, forth and manner as required by law as is evidenced by affidavits on file and of record in the office of the City Clerk of the City of Lodi; and W[AS, in accordance with the provisions stated in Resolution No. 84-045 and also contained in the posted notices of the adoption of said resolution, notice was given that a public hearing would be held before the City Council in the City Council Chanters, City Hall, Lodi, California, beginning at 8:00 p,rn. on Wednesday, May 16, 1984, where and when any person interested in or objecting to said vacation could appear and be heard in relation thereto; and 1iUEREAS, at that time and place a public hearing was held and conducted and testimony received for and against the vacation contemplated, and from the evidence submitted the City Council Of the City of Lodi did determine that said alley is unnecessary for present Or future public use and did so find and declare; • ) that the Planning Coranission did find that the subject vacation was consistent with the general plan of the City of Lodi; NCIN, TBER.EF?E, RE IT RESOLVED that pursuant to the findings and under the authority Of Section 8323 of the Streets and Highway Code of the State of California, there is hereby abandoned the alley located north of Louie Avenue between California Street and Lincoln Avenue, Lodi, California, with the conditions heretofore set forth.
