ELECTRIC COMPANY EXECUTED IN CONSIDERATI'QN OF THE
GRANT'BY THE . :CITY OP LODIOF THE FRANCHISE.
TO'USE THE STREETS„OF,SAID CITY ,FOR THE TRANSMISSION
AND DISTRIBUTION'OF GAS. FOR'ALL.PURPOSES OTHER THAN
THOSE AUTHORIZED UNDER SECTION.19,OF ARTICLE. XI OF THE'
CONSTITUTION OF THE STATE OF CALIFORNIA AS SAID SECTION
-EXISTED' PRIOR TO ITS AMENDMENT ON OCTOBER. 10 1911.
WHEREAS on the 20th day of' December 19 39,
the City Council of the City of Lodi passed its
ordinance granting to Pacific Gas and Electric Company, '
Al California corporation, the_franchise to use the public
streets, ways and planes of said city for the transmission
and 'distribution of gas for all purposes other than those
authorized under Section 19 of Article XI of the Constitution
of the State of California as said section existed prior to
its amendment'on'October 10 1911, upon' the terms and condi
tions as set forth 'in said ordinance; and.
WHEREAS said.' Pacific Gas and Electric Company
pursuant to the Franchise Act of 1937 has duly executed and.
filed:with this Council a bond in the penal sum of one.
thousand dollars ($1,000.00), bearing date the 20th day of
De.oember , 1939, and conditioned as prescribed by law;
and
WHEREAS upon due investigation and consideration, it
appears to the satisfaction of this Council that said bond is'
in proper form and that_ said bond,has been duly executed by
said Pacific Gas and.Eleatric Company and by two'good
and sufficient' sureties;
NOPE, THEREFORE, BE IT RESOLVED by the City Council •
of the City of Lodi'' . that said bond be, and itis
''hereby accepted end approved.
PASSED on the 20th day of December ., 19 39 , by
following vote:
