WHEREAS, this City Council, in accordance with law and with proceedings heretofore had in accordance and pursuant to its Hesolution of Intention No. 9+ passed and adopted January 3, 1938, did, on the Pith day of February, 193i pass and adopt its Resolution No. 9)4.7 Ireference to which is hereby made for further particulars) wherein the hour of 8:00 o'clock P.M. of Monday the 21st day of February, 1938 and the Council Chambers of this city Council were set as the time and place for the hearing of any and 81.11 objections filed or presented to this City Council in the matter of the opening, widening and extending of Tokay Street and Church Street, particularly the objections of John Kessel and Myrtle L. Kessel, his wife and of D. J. Phelps and Barian ±. Phelps, his wife, and it appearing on affidavit of the City Clerk that the said objectors had been notified of the time and place of said hearing in the manner provided By law; and said matters coming on to be heard; and none of said objectors or any representative thereof' appear-ing and asking to be heard in support of said objections; BE IT RESOLVED, that this council finds that objections were filed b. less than a majority of the owners of real property included in the district to be affected and benefitted by and to be assessed to pay the costs and expenses of said work and improvement and that said objections were not supported on hearing thereon although a 11 parties thereto were riven legal notice of the time and place of said hearing; and therefore said objections or purported objections are hereby overruled and denied. 0 Certified to be a full, true and correct copy of Resolution No. 949 of the City Council of the City of Lodi as passed and adopted in a regular meeting of said Council. held on Ivion.day, February 21, 1938 by the following vote: AYES: Councilmen, Graffigna, vJ'eihe , Clark, Spooner and Steele, mayor NOES: Councilmen , N one ABSENT: Councilmen, None.
