RESOLUTION NO. 762
R19OIIJIION DECLARING THE INTBNTION CF THE CITY COUNCIL
OF THE CITY CF LODI TO ABANDON A CKRTAIL ALLEYWAY IN
LOT 3? CF THR LODI BARNHART TRACT IN SAID CITY.
WHEREAS, ADAM HOFP has filed a verified petition requesting the
abandonment of that certain alley dedicated to public use in that
certain deed dated November 19, 1918, executed by R.B.Q'Deli and
Florence O'Dell, his wife, to Jacob Yank and recorded January 15,
1919 in Book '&" of Deeds, Vo1,355,page 182, San Joaquin County
Records, a copy of which petition is hereto annexed and made part
hereof for all purposes;
BE IT RESOLVED, by this City Council of the City of Lodi that
it is the intentian of said City Council that said alley be abandoned
in that the sane has never been opened to public use nor is the use
of the same essential in the development of the lands adjoining it
nor is it an essential means of ingress or egress to any of the lands
appertaining thereto;
The said alley herein proposed to be abandoned is particularly
described as follows :A portion of Lot 37 of the Lodi Barnhart Tract
as said Lot is delineated and so designated on that certain map or
plat entitled "Lodi Barnhart Tract 11 filed for record November 5,1906
and recorded in Vol. 3, Page 48 of Book of Maps and Plats, San Joaquin
County Records, being the northerly tan (101 feet of the following
tract of land, commencing fop the sane on the Intersection of the
East line of Washington Avenue and the North line of Vine Street,
running thence easterly on and along the said Worth line of Vine Street
distance of one hundred thirty (13.Q) feet, running thence northefly
and parallel to the East line of Washington Street a distance of two
hundred (200) feet; thence westerly and paraall$l to the: North line of
Vine Street a distance of one hundred thirty (130) feet to the East
line of Washington Street, thence southerly on and along the said
Bast line of Washington Avenue a distance of two hundred (200) feet
to the point of beginning;
BE IT FURTHER RESOLVED, that the Street Superintendent of the
City of Lodi bet, and he is hereby directed to post and publish notice
hereof at the time and in the manner required by law, such publication
to be had in "THE LQDI NE1S" a newspaper of general circulation here.

was regularly passed and adopted at a regular meeting of said
City Council held Monday, the first day of April, 1936 by the

AFFIDAVIT OF POSUNI' NOTICES OF PUBLIC WORK AND OF THE COMPLETION
OF SAID POSTING.

B. C. DOUGHS.RTY, first being duly sworn, deposes and says:
That he is now end was during all the times mentioned herein, the
duly appointed, acting and qualified Street Superintendent of the City of
Lodi;
That, on Monday, the first day of April, 1935, The City Council of
the City of Lodi passed and adopted its Resolution No.,,T62, wherein the
said City Council declared its intention to order the foliowingwwork to
be done in said City, torwit:
The abandonment of that certain alley dedicated to public uss in
a deed from R.B.O!Dell end wife to Jacob Yanke dated November 19, 1918
Particularly described as folios:,.
The northerly ten feet of the following tract of land, commencing
for the same on the East line of Washington Avenue at its intersection
with the North line of Vine Street and running thence easterly on and along
the said North line of Vine Street a distance of one hundred thirty feet;
thence Northerly and parallel to the East line of Washington Avenue a
distance or two hundred feet; thence westerly and parallel to the North
line. of Vine Street a distance of one hundred thirty feet; thence Southerly
on and along the Bast line of Washington Avenue a distance of two hundred
feet to the point of beginning, being a portion of Lot 34 of The Lodi
Barnhrt Tract.
That, after the adoption of said Resolution No. 762., he personally
posted notices conspicuously along the line of said allay and in front
of all property abutting thereon, notices of the passage of said resolute
ion. headed a NOTICE CF PUBLIC WORK u in letters: not lass than one inch
In heighth, a copy of which notice is annexed hereto and made pest hereof.
That he posted said notices by nailing them with metal tacks to posts,
fences, walls or trees, in such a manned: that they would attract attention
of passers4y and be es,stly readable;
That he measured the distance between each notice posted and knows that
all of them sere posted less then 300 feet apart and that not less that three
(3) notices were posted on said alley; torwit, that five (5) notices in ell
were so posted;
That he eotaplated the posting of said notices on the eighth day of
April, 1936, and thereupon made and filed this affidavit.

Notice is hereby given that the City Council of the City of Lodi, County of San
Joaquin, State of California, did adopt its Resolution of Intention No. 762 on Mon-
day, the first day of April, 1935, wherein it was declared that said City Council in-
tended to abandon that certain alley dedicated to public use by deed from R. B. O'Dell
and wife to Jacob Yanke dated November 19,1918,particularly described as follows:
The northerly ten feet of the following tract of land, commencing for the same
on the intersection of the East line of Washington Avenue and the North line of Vine
Street and running thence easterly on and along the said North line of Vine Street a
distance of one hundred thirty feet, thence Northerly and parallel to the East line of
Washington Avenue a distance of two hundred feet, thence westerly and parallel to
the North line of Vine Street a distance of one hundred thirty feet tp the Zast line of
Washington Avenue, thence southerly on and along said East line of Washington
Avenue a distance of two hundred feet to the point of beginning, being a portion of
Lot 37 of the Lodi Barnhart Tract.
The said Resolution No. 762 is on file in the office of the City Clerk of the City
of Lodi and is here referred to for further particulars.
Persons objecting to the abandonment of said alley may file their written objec-
tions with the said City Clerk at the time and in the manner provided by law.
