RESOLUTION No. 650
RESOLUTION DISMISSING APPEALS AND CONFIRMING
ASSESSMENT.
WHEREAS, the City Engineer did on the 19th day of September,
1931 file with the City Clerk of the City of Lodi, an assessment to
represent the costs and expenses of the street work and improvement
done and made by RAYMOND H. CRUMEY and/or his successors and/or
assigns, pursuant to Resolution of Intention No. 72 of the.City
Council of the City of Lodi, adopted April 13, 1931
AND WHEREAS, the City Clerk has duly given notice by pub-
lication and posting in the time and manner provided by law, of
the filing of said assessment and of the time set for hearing there-
on, which time was fixed in said notice as the 12th day of October,
1931 at the hour of 8.00 o'clock P.M. of said day ;
AND WHRAS certain persons have purported to appeal to
the City Council of the City of Lodi against the confirmation of
the said assessment and diagram thereto annexed ;
AND WHEREAS, the said. City Council has duly and regularly
received, beard and considered said apoeals and has received evid-
ence oral and documentary concerning tae correctness of said assess-
ment and of the -proper completion o the street work and improve-
ment for which tae sane was issued
AND WHEREAS, the said hearing has been regularly adjourned
and continued to this the 13th day of October, 1931 at the hour Of
8.45 o'clock in the forenoon of said day ;
NOW, THEREFORE, IT IS HEREBY RESOLVED, by the City Council
of the City of Lodi that all appeals of every kind and nature be
and the same are hereby overruled and denied
RESOLVED, further, that the said assessment and the diagram
and warrant attached thereto, the proceedings leading up to the same
and all acts and determinations of the Superintendent of Streets
and of the City Engineer in relation thereto,be, and the same are
hereby confirmed, ratified and approved, and the Superintendent of
Streets is hereby ordered to deliver said warrant, assessment and
diagram to G. D. Myers, assignee of Raymond H. Crummey, the eon.*
tractor, or to his agents or assigns, forthwith upon the payment
by him or them of the incidental expenses due thereon.
