A RESOLUTION OF THE LODI CITY COUNCIL CERTIFYING
MITIGATED NEGATIVE DECLARATION, AUTHORIZING THE CITY
MANAGERTO EXECUTE CONTRACT FOR CONSTRUCTIONAND
ADDITIONAL PROFESSIONAL SERVICES TASK ORDER FOR
CONSTRUCTION MANAGEMENTAND DESIGN SERVICES FOR
WHITE SLOUGH WATER POLLUTION CONTROL FACILITY
BIOSOLIDS DEWATERING AND STORAGE FACILITIES PROJECT,
AND FURTHER APPROPRIATING FUNDS
WHEREAS, the California Environmental Quality Act (CEQA) requires that
projects be reviewed for their potential to create environmental impacts. Staff prepared
an Initial Study and Mitigated Negative Declaration to review and assess potential
impacts; and
WHEREAS, the Initial Study and Mitigated Negative Declaration was sent to
various agencies for review, was published, and the City posted an intent to issue an
Initial Study and Negative Declaration for the 21 -day period between July 16, 2009 and
August 11,2009; and
WHEREAS, it was determined that construction of this project will not result in
significant impacts that could not be mitigated by making changes to, or placing
conditions on, the project. No new impacts were identified in public testimonies that
were not addressed as normal conditions of project approval in the initial study; and
WHEREAS, staff finds that the proposed project has complied with
environmental requirements and is therefore exempt from further review under CEQA.
Mitigated Negative Declaration 09 -MND -02 adequately addresses potential
environmental impacts that could occur as a result of this project. It has been determined
the project site is currently covered under the San Joaquin County Multi Species Habitat
Conservation Plan as part of the environmental clearances obtained for the construction
of the Northern California Power Agency Lodi Energy Center; and
WHEREAS, in answer to notice duly published in accordance with law and the
order of this City Council, sealed bids were received and publicly opened on
November 11, 2010, at 2:00 p.m. for the White Slough Water Pollution Control Facility
Biosolids Dewatering and Storage Facilities, described in the specifications therefore
approved by the City Council on August 4,2010; and
WHEREAS, said bids have been checked and tabulated and a report thereof
filed with the City Manager as follows:

WHEREAS, staff recommends awarding the contract, including Additive Bid Item
No. 1—the extended canopy and canopy support ($125,000) for the White Slough Water
Pollution Control Facility Biosolids Dewatering and Storage Facilities to the low bidder,
Cushman Contracting, Inc., of Goleta, California, in the total amount of $3,715,000; and
WHEREAS, staff recommends approval of Task Order No. 30 to the Master Task
Order Agreement dated January 13, 1999, with West Yost & Associates to perform the
construction management and design services during construction, including design and
implementation of Supervisory Control and Data Acquisition System improvements, on a
time -and -materials basis with a not -to -exceed maximum of $478,830.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
certify Mitigated Negative Declaration 09 -MND -02; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize
the City Manager to execute the construction contract for the White Slough Water
Pollution Control Facility Biosolids Dewatering and Storage Facilitieswith the low bidder,
Cushman Contracting, Inc., of Goleta, California, in the total amount of $3,715,000,
including Additive Bid Item No. 1; and
BE IT FURTHER RESOLVED that the Lodi City Council does hereby authorize
the City Manager to execute Task Order No. 30 for construction management and
design services for the White Slough Water Pollution Control Facility Biosolids
Dewatering and Storage Facilities with West Yost and Associates, of Davis, California,
on a time -and -materials basis not to exceed $478,830; and
BE IT FURTHER RESOLVED that funds in the amount of $4,950,000 be
appropriated from 2007 Wastewater Certificate of Participation funds.
