HomeMy WebLinkAboutResolutions - No. 1098In the City Council City of Lodi Lodi, California RESOLUTION N 0 . 1098 WHEREAS, a dangerous condition exists on Tokay Street at the crossing of said street with the right of way of Southern Pacific Company and Central Pacific Railway Company, its lessor, WHEREAS, said companies are willing to execute a "Street or Highway Agreement" with the City of Lodi and has submitted a draft of said agreement to this City Council, whereby Tokay Street may be realigned and certain existing obstructions removed all to the betterment and safety of said crossing, and, WHEREAS, the City of Lodi has sufficient funds accumulated to do the work on its part to be performed as in said agreement set forth, therefore, BE IF RESOLVED, that the Mayor be, and he is hereby authorized, empowered and directed to make and execute, for and on behalf of this City, the said agreement with the southern Pacific Company and the Central Pacific Railway Company, for the right to construct, maintain and use portions of the lands of said company for the straightening and widening of said Tokay Street subject to the provisions and restrictions in said agreement set forth. 0 Certified to be a full, true and correct copy of Resolution 1Vo. 1098 of the City council of the City of Lodi as passed and. adopted in a regular meeting of said Council held Wednesday, November 5, 190. by the following vote: APES : Councilmen, weihe, Bull, Kinn, Riggs and Steele NOES : Councilmen, None ABSENT: Councilmen, None City Clerk DATED: November 5, 1941
