HomeMy WebLinkAboutResolutions - No. 1043In the City Council Cityof Lodi Lod, California RESOLUTION NO. 104.3 RESOLUTION ORDERING THE ABANDONMENT CF A PORTION CF FORREST AVENUE AND AN ALLEY IN BLOCK 3 CP "FORREST'S ADDITION TO LODI". WHEREAS, this City Council of the City of Lodi did on the 21st day of February, 1914.0 adopt its Resolution of Intention No. 1033 wherein it was declared that this City Council did intend to abandon and close up a certain portion of Forrest Avenue (formers /Addition Lodi, more particularlyldescribedBlock hereinafter, of Forrest d and, WHEREAS, it appears that due notice of such intention was regularly posted and published in time, form and manner as required by law as i s evidenced by affidavits on file and of record with the City Clerk of this City, and, WHEREAS, more than ten days have elapsed since the last publication of said notice and since the posting of copies thereof and no objections to the abandonment of said portion of said street and said alley have been filed with or presented to this City council or to the Clerk thereof, and therefore this City Council has now acquired jurisdiction to order the same abandoned and closed up, now, therefore; This City Council finds as a fact, in view of the fore- going, that said notices of proposed abandonment were duly and regularly posted and published at the times, in the form and. in the manner provided by law and the direction of this City council; that no objections have been filed or presented; that the time for the filing of said objections has expired and that this City Council now has jurisdiction in this matter, as aforesaid, This City council also finds, determines and declares that the portion of said street and said alley herein abandoned and closed up are not required for public use, therefore, BE IT RESOLVED, that it is to the public convenience and benefit that said portion of Forrest Avenue and said alley be abandoned and closed up as public ways, and the same are hereby abandoned and closed up ; which said portion of street and said alley are particularly described as follows: Forrest Avenue (formerly Woodbridge Avenue) from the west line of 'Jalifornia Street to the east line of Grant Street and also that certain alley, twenty .feet in width, extending from the west line of Califor is Street to the east line of Grant Street in Block d, all as delineated on the official map of "Forrest's Addition to Lodi". Certified to be a full, true and correct copy of Resolution No. 10L3 as passed and adopted in a regular meeting of the City council of the City of Lodi held on Wednesday, March 20, 1940 by the following vote: AYES: Councilmen, Graffigna, UVeihe Clark, Spooner and Steele.
