HomeMy WebLinkAboutResolutions - No. 1026,SOLiJTION NO. 1026 RESOLUTION ORDERING THE ABANDON10111T OF AN ALLEY IN ZILKE SUBDIVISION. >1HEREAS, this City Council of the City of Lodi did, on the 6th day of December, 1939, adopt its Resolution No. 1012, wherein it declared its intention to abandon a certain alley in ZILKE SUBDIVISION as petit- ioned for by Henry Zilke and Olga Zilke, his wife, and, WHEREAS, it appears that notice of such intention was regularly posted and published in time, form and manner as required by law as is evidenced by affidavits on file and of recordwith the City Clerk of this City, and, WHEREAS, more than ten days have elapsed since the last publication of said notice and since the posting of copies of said notice and no objections to the abandonment of said alley have been filed or present- ed. to this City Council or to the clerk thereof, and this City Council has now acquired Jurisdiction to order the abandonment of the said alley; NOW, THEREFORE, this City Council, in view of the foregoing, finds as a fact, that the said notices of abandonment were duly and regularly posted an:1 published in the time, form and manner as prescribed by law and the direction of this City Council; that no objections were filed or presented end that the time for filing of such objections has expired end, that this City Council. has now jurisdiction in this matter as aforesaid; and that the said alley is not; required to serve any public use; therefore, BE IT RESOLVED, that it is to the public interest and benefit that the said alley be abandoned and closed up and It is hereby ordered that the alley next hereinafter described be abandonei! and closed up as a public alley. The alley herein abandoned arid closed up is particularly described as follovra: Beinning at a point on the southerly line of. Cherry Street distant one hundred twenty (120) feet Easterly from the east Line of Stockton Avenue and running thence Southerly and par- allel to the east line of Stockton Street to a point on the north line of Nine Street, thence Easterly on the north line of Vine Street a distance of twenty (20) feet to a point, thence Northerly and parallel to the east line of Stockton Street to the south line of Cherry Street, thence Westerly on the south line of Cherry Street, a distance of twenty (20) feet to the point of beginning. 0 Certified to be a full, true and correct copy of Resolution No.1026 of the City Council of the City of Lodi as passed and adopted at a regular meeting of the said City Council. held on Wednesday, the 17th day of January, 1940 by the following vote: - AYES: Councilmen, Clark, Graffignn, Spooner, Weihe and Steele. NOES: Councilmen, None. ABSENT: Councilmen, None. City Clerk and ex -officio Clerk of the January 17. 1940. City Council of the City of Lodi.
