HomeMy WebLinkAboutResolutions - No. 04-16-1923cCity of Lodi Resolution ort' Intention No. V2 STOCKTON AVENUE RESOLVED, that It is the intention of tae Board of Trustees of the City. of Lodi, in the County of San Joaquin. sta.e of Calilorata, to order the tol- lowing work to be done and Improve - meat to he made In sand' City of Lodi, t0-w!t: That Stockton Avenue, in said City of Lodi, frgni the southerly termina- tion of the present pavement on or rear a line 221 feet southerly from and parallel to the northerly line of Lot numbered 57 of the Lodi Barnhart Tract, as said tract is shown on that certain map entitled "Lodi Barnhart Tract" and recorded In the office of tae County Recorder in Vol. 3 of flaps at Page 48, San Joaquin County Rec- ords. produced westerly across said Stockton Avenue, to the aertberly Ilne of Vine Street, including all street and alley crossings, terminations and op- posite terminations within said limits. BE IMPROVED: (1) By grading the roadway and curb and gutter spaces of said portion of Stockton Avenue. (21 By constructing hydraulic con- crete cur�•s and gutters of the com- bined type along each side of the road- way of said portion or said Stockton Avenue. (3) By paving the roadway of said portion of S•tacktan Avenue be- tween the gutter lines, with a pave - meat consisting of one and one-half (11A) inches of Warreaite Wearing Surface laid on an asphaltic concrete base two and one-half (2%) inches In thickness. Excepting, however, from all of the hereinabove described work such por- t!ous as are required by law to be kept in order or repair by any any person or company having railroad tracks thereon; and excepting also from all of the hereinabove described work, any of said work already done to the official line and grade. All of said work shall be done In accordance with the plans and speci- fications heretofore adopted for doing ;s.!d work and now on file in the office of the City Clerk of said City of Lodi. .attention is also called to the Warrenite License Mixture Agree- ment for California. executed by 'Warren Brothers Company the own- ers and holders of united States Patents covering the said Wtirrenite pavement. on February 190, 1923, which agreement Is on file in the office of the City Clerk of the City of Lodi, and which is hereby expressly referred to for greater certainty. And said Board of Trustees does hereby determine and declare that said proposed work and improvement is of more than local or ordinary pay Ilc benefit, and will affect and benefit the lands and district herein- after described, which said district is hereby declared to be the district benefited by said work and improve- ment, and to have the exterior boun- daries hereinafter described as 'the boundaries thereof; that, therefore, the entire cost and expenses of said work and improvement shall be, and are hereby made, chargeable against, and shall be assessed upon said lands and district, which district is within tha City of Lodi. County of San Joa- quin, State of California, and is par- ticularly bounded and described as follows, Co-wltt Commencing at a point on the Easterly line of Lot numbered 57 of the Lodi Barnhart Tract herelabefore mentioned. distant thereon Southerly two hundred twenyt-one (221) feet from the Northeast corner of said lot. and running thence southerly on and along the said Easterly line of Lot numbered 57 and its Southerly pro- duction, to an intersection with the Northerly line of Vine Street Insaid City of Lodi; thence, Westerly on and along the said Northerly line of Vine Street and -its Westerly production to a point which Is distant thereon two hundred eight and two -hun- dredths (203.02) feet Westerly from the Westerly line of said Stockton Avenue; thence Northerly on a direct line to a point an a line drawn paral- lel to and one hundred fifty-five (155) feet Southerly from the North. erly line of Lot numbered 70 in said Lodi Barnhart Tract, which last men. tianed point on said parallel line is distant thereon one hundred eighty. two and two hundredths (182.02) feet Westerly from the Westerly line of said Stockton Avenue; thence Faster. ly on a direct line to the point of comritencement- Saving, excepting and excluding from said district, the area of all public streets, avenues. Innes, alleys and public ways therein included and contained. The extent of the territory to be Included In said assessment district is indicated by a boundary fine upon a diagram entitled, "Diagram Indicat• ing by Boundary Line the Extent of Territory to be Included in the Dis. trict to be Assessed for the Improve - meat Provided for by Resolution of Intention Numbered 62;' which said diagram was approved by the Board of Trustees of said City of Lodi, on the 16th day of April, A. D. 1293, ref- erence to which diagram is hereby made for greater certainty. And it Is further ordered and notice Is hereby given that serial bonds to represent unpaid assessments and bear Interest at the rate of sever (7) per cent per annum, will be Issued hereunder in the manner provided by the Improvement Bond Act of 1915, and Acts amendatory thereto, the last Installment of which bonds shall ma, tura nine years from the tad day of July neat succeeding alne months from their date. This Resolution of intention is adopted pursuant to the provisions of these certain Acts of the Legislature of the State of California, designated respectively as the "Improvement Act of 1911," and the "Improvement Bond Act of 1915;' and Acts amenda. tory thereto, and future proceedings hereunder shall be taken and bad in accordance with the provisfons of said Acts. NOTICE IS HEREBY GIVEN, that on Monday, the 7th day of May, A. D. 1923, at 8 o'clock P. M., in the Council Chamber of the said Board of Trus- tees, in the City Hall of said City of Lod!, any and all persons having any objections to the proposed work or Improvement may appear -before said Board and show cause why said pro- posed improvement should not be car- ried out in accordance with this Reso. lution. The Clerk of this Board of Trustees Is hereby directed to cause this Reso- lotion of Intention to be published three times in "The Lodi News," a newspaper published and circulated three times each week in said City of Lodi and hereby designated for that purpose by the Board Of Trustees, there being no daily newspaper pub- lished in said City. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplated work sad improvement and in trout of all property liable to be assessed, notices of the passabe of this Resolution of Intention, In the manner and form re- quired by law.
