Home My WebLink AboutAgenda Report - November 6, 1996 (76)e CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Acquisition of Public Utility Easement, 2459 Maggio Circle ($3,670) MEETING DATE: November 6, 1996 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council adopt a resolution approving the purchase agreement for a 20 -foot public utility easement at 2459 Maggio Circle and authorize the City Manager and City Clerk to sign the agreement as well as a quitclaim deed to relinquish a 12 -foot undescribed easement across this same property. BACKGROUND INFORMATION: In order to provide sanitary sewer service for backwashing the granulated activated carbon (GAC) system that was installed at Well 23, additional easement area is needed across 2459 Maggio Circle. The City presently has a 12 -foot undescribed easement across this property to give us access to the well site but not for installation of underground utilities (prior to GAC, it wasn't needed). With the acquisition of this 20 -foot easement, the undescribed easement will be incorporated into the new easement and the undescribed 12 -foot easement will be quitclaimed to the owners. Under the terms of the purchase agreement, the City will pay Robert and Carolyn Reynolds and Donald and Sonja Reynolds, the owners of the property, $3,670 based on an appraisal completed prior to negotiating with the owners. There are already several small easements within the new 20 -foot easement that were acquired at the time the subdivision was developed. The Reynolds are not being paid for the areas already deeded to the City. Actual area of new easement acquired is 2,930 square feet. Exhibit A shows the location of the easement. The only other option to acquiring the easement and installing the sanitary sewer line is the installation of a back flush tank on the well site. This could cost in excess of $50,000. The City is also installing a water line in this easement to more efficiently serve this developing industrial area. We expect to start work on the new utility lines as soon as possible. To expedite the installation of utilities, the work will be done by City forces at an estimated cost of $8,400 for the water line and $11,400 for the sanitary sewer.
