HomeMy WebLinkAboutResolutions - No. 2008-203 ERRESOLUTION NO. 2008-203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI, CALIFORNIA, ACCEPTING CERTIFICATE OF SUFFICIENCY OF PETITION FOR THE REFERENDUM AGAINST ORDINANCE 1812, WHICH APPROVED AND ADOPTED THE REDEVELOPMENT PLAN FOR THE LODI COMMUNITY IMPROVEMENT PROJECT WHEREAS, the Lodi City Council, on July 2, 2008, adopted Ordinance 1812 approving and adopting the Redevelopment Plan for the Lodi Community Improvement Project; and WHEREAS, on September 26, 2008, the City Clerk's Office received a referendum petition in protest of the City Council's adoption of Ordinance 1812; and WHEREAS, said petition must contain 2,615 valid signatures, which is 10% of the voters in the City of Lodi as last officially reported by the county elections office to the Secretary of State (26,152); and WHEREAS, the San Joaquin County Registrar of Voters has conducted an examination of the petition and determined it to be sufficient. In accordance with Elections Code §9114, the City Clerk hereby certifies the results of the examination to the City Council as set forth in the attached Certificate of Sufficiency of Petition (Exhibit A). NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council hereby accepts the Certificate of Sufficiency for the referendum petition against Ordinance 1812, which approved and adopted the Redevelopment Plan for the Lodi Community Improvement Project. Dated: October 15, 2008 hereby certify that Resolution No. 2008-203 was passed and adopted by the City Council of the City of Lodi in a regular meeting held October 15, 2008, by the following vote: AYES: COUNCIL MEMBERS — Hansen, Hitchcock, Johnson, and Katzakian NOES: COUNCIL MEMBERS— Mayor Mounce ABSENT: COUNCIL MEMBERS — None ABSTAIN: COUNCIL MEMBERS—Non City Clerk EXHIBITA CERTIFICATE OF SUFFICIENCY OF PETITION I, Randi Johl, City Clerk of the City of Lodi, California, do hereby certify the following: The petition for the Referendum against Ordinance 1812, An Ordinance of the City Council of the City of Lodi Approving and Adopting the Redevelopment Plan for the Lodi Community Improvement Project, was filed in my office on September 26, 2008. The petition was forwarded to the San Joaquin County Registrarof Voters, where the petition signatures were verified (based upon a full check) pursuant to California Elections Code §9114. The number of registered voters in the City of Lodi, as reported to the Secretary of State on September 10, 2008, is 26,152. The results of the examination by the Registrar of Voters were as follows: 1. Number of signatures filed: 4,511 2. Number of signatures verified: 4,511 3. Number of signatures found sufficient: 4,290 The number of valid signatures is more than the 2,615 required signatures to qualify the petition; therefore, I certify the petition for the Referendum against Ordinance 1812 as sufficient. hereby set my hand and official seal this 15th day of October 2008, at Lodi, California RAbH0fiL City Clerk
