WHEREAS, the City of Lodi has been unable to secure bidders will- inc and able to do the work contemplated in the construction of the Sacramento Street Industrial Waste Drain as appears from the City Councils minutes for September 4, 1946 as recorded in Vol. 7 Records of the City Council, at Page 83 thereof, and, WHEREAS, this City has also been unable to contract for the con- struction of its Main Line Sewer Outfall at a fair and reasonable price, having rejected the only bid received by its Resolution No. 12VA adopted November 20, 1946, and, WHEREAS, both of these projects are necessary for the preservation of the public health, safety and convenience and must be completed before another Summer season or the City may be prohibited by injunction from continuing its present methods of sewage and industrial waste disposal, and, WHEREAS, Homer Wright i s the comer of a certain Model 21, Parsons Trenching Machine and has submitted a proposal in writing to do the digging of trenches necessary to construct the sewer lines for both the Sacramento Street Drain and Unit 1 of Pipe Line 1 of the Main Line Sewer Outfall at a price of $12.00 per hour under terms and conditions acceptable to this City Council as set forth in his said proposal; therefore, BE IT RESOLVED, that this City Council accept the proposal of Homer Wright and directs that the City Engineer proceed immediately with the construction of both of the projects named herein. Payments due Homer Wright shall be made on certificate of the City Engineer a,9 4%0 the time this machine is employed and that the work is satisfactory. 0 Certified to be a true copy of Resolution No. 1292 passed and adopted by the City Council of the City of Lodi in regular meeting held December 4, 194.6 by the following vote AYES: Councilmen, Haskell, Riggs, Lytle, Tolliver and Rinn NOES: Ccunnilmen, None.
