AGENDA TITLE: Consider an Appeal Received from Riney Bender on Behalf of American Legion
Lodi Post No. 22 Regarding a Decision of the Recreation Commission to
Increase Rental Fees for Use of the Parks for American Legion Baseball

RECOMMENDED ACTION: Review 1996 baseball field rental fee schedule as set by the Recreation
Commission November 7, 1995.
BACKGROUND INFORMATION: The Parks and Recreation Commission reviewed fees and charges
for Zupo and Kofu ball field rentals during their regular meetings
of September 5, 1995, October 3, 1995, and November 7,
1995 for the 1996 season. All renters of the two facilities
were notified of the meetings and encouraged to attend.
The Parks and Recreation Commission took action at the November 7, 1995 as follows: rental rates
would be determined by actual costs (maintenance base, diamond prep, lights if needed) and group
classification. Group I (local youth) 25% of cost; Group II (local adult) 50% of cost; Group III (non -local
youth/adults) 75% of cost; Group IV (professional/other) 100% of cost. (See attached.)
As shown on the attached chart, three of the five uses for Group I (local youth) were actually reduced
over the 1995 rate. Most of the rate increase fell on non -local and professional renters.
FUNDING: The Parks and Recreation Department has been directed to recover 30% of program
costs with youth fees relatively low, adult fees relatively high as indicated in the 1995-
97 budget document . These fees have been set to help meet this goal.

' Tony Cabral, 25692 N. Cherokee Lane, Acampo, spoke against any increase in diamond rental
fees.
Motion by Commissioner Land to eliminate different fees for tournaments, eliminate doubleheader
fees, and charge the following percentage of total cost: group I - 25%; group II - 50%; group III -
75%; group IV - 100%. Motion died for lack of a second.
Motion by Commissioner Land, second by Commissioner Melby to charge the following percentage
of actual cost for diamond rentals: group I - 25%; group II - 50%; group III - 75%; group IV - 100%;
and further, to eliminate the tournament fee and charge a tournament the actual cost percentage
as to the group classification schedule.
Motion by Commissioner Wall, second by Commissioner Melby to amend the above motion to add
a cost -of -living increase (CPI) to the fees yearly.
Ayes: Commissioners Land, Melby, Wall
Noes: Commissioner Johnson
Motion carried 3-1
V. Regular Agenda - Other Reports and/or Updates
A. Skate Park Facility Presentation
Verbal and video presentation by Josh Korbin and Michael McIntyre both residing at 615 W. Locust
Street, Lodi.
A Skate Park Task Force Committee has been formed. The goal of the committee is to provide
young people in the Lodi area a safe and accessible skate boarding and inline skating facility. They
came before the Commission requesting support of a three-month indoor facility pilot project
beginning January 1, 1996, and help in finding a free facility. Negotiations have begun for use of
the old Boys and Girls Club building on the Lodi Grape Festival grounds at a cost of $1,000 per
month.
Youth Commissioner Jennifer Rios was present and stated that the Youth Commission supports the
skate park facility 100%. She does not know why it was removed from the Youth Commission
agenda, however, she will request that it be placed back on the agenda.
Supervisor Van Noy indicated that insurance for this activity is still an issue. Commissioner
Johnson suggested going to City Council and request council to assume liability for the 90 -day pilot
period to see if the program is successful.
Motion by Commissioner Johnson, second by Commissioner Wall, to move forward with this project
and prepare for City Council.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on Wednesday, July 17, 1996 at the hour of 7:00 p.m.,
or as soon thereafter as the matter may be heard, the City Council will conduct a Public
Hearing at the Carnegie Forum, 305 West Pine Street, Lodi, to consider the following
matter:
a) appeal received from Riney Bender on behalf of American Legion Lodi Post #22
regarding the decision of the Recreation Commission to increase rental fees for
the use of the parks for American Legion baseball
All interested persons are invited to present their views and comments on this matter.
Written statements may be filed with the City Clerk at any time prior to the hearing
scheduled herein, and oral statements may be made at said hearing.
If you challenge the subject matter in court, you may be limited to raising only those
issues you or someone else raised at the Public Hearing described in this notice or in
written correspondence delivered to the City Clerk, P.O. Box 3006, at or prior to the Public
Hearing.
