HomeMy WebLinkAboutResolutions - No. 2120In the City Council City of Lodi Lodi, California BESCLOTION NO. 2126 BZOOLUTIOS Or TIM CITY LODl OVUM tic .Or o201 SAT2 SAID manor IS TOE COUNCIL,Or TES eor ASOIITOO D STRICT WHEREAS, undas the provisions of that certain Act of the Legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", proceedings for the annexation to the City of Lodi of the territory hereinafter particularly described have>.jbeer: initiated by the filing of a petition for annexation to the City of Lodi of the territory hereinafter described by the owners of all of the land, both by area and assessed value, in said territery proposed to be annexed, and WHEREAS, the exterior boundaries of said territory described in said petition and which territory is contiguous to the limits of the City of Lodi, San Joaquin County, State of California, are described as follows: A portion of the Southwest Quarter of the Northwest Quarter of Section 2, Township 3 North, Range 6 East, Mount Diablo Base -and 1[ei idian, and more particularly described as follows: Beginning at a point on the west line of Lot 26, Gerard Tract, as filed for record August 8, 1916 in Volume 8, Ione 62, Book of Nope a Plats, Sirs Ragan County WW1, which point is ie rest south of the Southwest canner of Lot 19, Gerard: Tract, and which point is also a corner of the present boundary of the City of Lodi; thence northerly along the West lint of sold Lots 26 and 19, 208.83 feet to the Northwest corner of Lot 19; thence 1. easterly 621.9 feet along the north line of Lot'19 to the west line of Lora Drive, previously known as Lockeford Avenue; thence southerly along the west line of Loma Drive 208.83 feet to a point 12 feet south of the south line of loot 19; thence westerly along a line 12 feet south of rind parallel to the south line of said Lot 19, which line is also a City boundary, 623.8 feet to the point of begin- ning; containing 2.97 cares, more or less, WHEREAS, the aforesaid petition further requests that the above described property be classified in the R-4 Residential District, such classification to be effective coincident with the effective date of the annexation as provided in Section +.2 of Ordinance 1(0. 469 of the City of Lodi, and WHEREAS, the aforesaid petition for annexation of the territory hereinbefore described to the City of Lodi, a municipal corporation, has been filed with and received by the Council of the City of Lodi, and SAS, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the provisions of the Annexation of Uninhabited Territory Act of 1939, and WHEREAS, the boundaries of said territory have been approved by the County Boundary Commission of San Joaquin County as to their definiteness and certainty at a meeting of that body on April 21, 1958, now therefore BE IT P goI.YED, as follows: 1. That the City Council of the City of Lodi does by this resolution give notice of such proposed annexations (does hereby give notice of its intention to zone said property R-4 Residential to become effective coincident with the effective date of the annexation!) does hereby designate said territory as "Becker 2. Addition"; and further, does fix Wednesday, June 18, 1958, at tie hoar of 8:00 o'clock p.m. at the City Council Chambers, City Hall, Lodi, California, as the day, hour and place when and where any person owning real property within such territory so proposed to be annexed axed having any objection to the proposed annexation may appear before the City Council and show cause why said terri- tory should not be annexed. 2. That the Clerk of the City of Lodi be and she is hereby directed to cause a copy of this resolution to be published at least twice in the "Lodi News -Sentinel", a newspaper printed, puh ished and circulated in the City of Lodi, the municipal cor- poration to which it is proposed to annex the hereinbefore described territory, all in the tine, form and manner required by law, and that all owners of the property proposed for annexation having signed the petition for such annexation, publication of a copy of this resolution ottside of the City Liaits of the City of Lodi is there- fore waived in accordance with Section 35311 of the Government Code. 3. That at any time not later than the hour set for hearing objections to the proposed annexation, any owner of property within the territory proposed to be annexed may file written protest against the proposed annexation; that such protests shall state the nage or names of the owner or owners of the property affected thereby and the description and area of such property in general terns. Certified to be a full, true and correct copy of Resolution No. 2120 of the City Council of the City .of Lodi and that the same was passed and adopted in regular meeting of said City Council held May 7, 1958.
