HomeMy WebLinkAboutResolutions - No. 2118RESOLUTION NO. 2118 JOINT RESOLUTION ESTABLISHING THE SAN JOAQUIN AREA PLANNING COMMISSION "ARTICLES OF ORGANIZATION" it has boon found necessary, in order to promote the physical and cultural growth of San Joaquin County, to influence a sound industrial, commercial and agricultural economy, as well as to prP*ote a desirable home and recreational environment, to form the Sam JOoquin Area Planning Commission. SOirpl Prgvislam 1. An area planning o6ardiision is hereby established under Section 66090 to 65094 inclusive, of time Government Cods, State of California, .1. T$ Commission shall be known as the SAN JOAQUIN AREA PLANNING CESSION. Bereihafter it will be referred to as the Commission. 3. The area embraced in contiguous and is oncompaased by the exterior boundarlos of San Joaquin COunty, 4. The duties and scope of the Commission shall be limited by Sections 65460 to 65474 inclusive, of the government Code, State of California. 5. The governing .body of the Comsmissio4 is the Board appointed as hereinafter provided. 6. Thi Cosaission shall come into being by, and date Trap, the passage of this resolution by the Board of Supervisors of San Joaquin. County after each City -Council of Stockton, Lodi, Tracy, Manteca, Ripon and Becalm has passed this Joint resolution, and the Chairman of said Board and the Mayor or Vice -Mayor of each of said cities have signed the "Operating Contract for the San Joaquin Area Planning Commission," a oapy of which in attached, marked "Exhibit A", which provides the plan.for the organization, operation and financing Mutually agreed upon by the co-operating cities and County. Each city resolving the creation of the Comeission is en- titled to be represented on the Commission by one member of its city planning commission, except that the City of Stockton is en- titled to be represented by two members of its City Planning Com- eission,aad the County of San Joaquin by two members of its County Planning CoomissiOn, each of whom shall be appointed•b}'ths Chief Executive of that city or county. All appointments must be made with the approval of the legislative body of the city or county affected. 2. Each Commissioner shall serve for lour (4) years or until removed, or until his successor is appointed or until be uses to b. a *weber of the Commission from which he is appointed,afd shall have one vote. A majority of votes cast is required for the adop- tion of any mutton or resolution or the authorization of any con- tract or financial expenditure or commitment by the Commission. A resolution shall fail in case of a tie vote, III. Power, 1. The Commission may accept and expend money received from local, state and federal governmental agincies and privets sources, to engage in area planning. 2, The Commission may employ a qualified planning staff, 3, A11 functions of the Cosssission shall be purely advisory to the Cities and County, and to their Planning Comssissions con- cerned. IV. financing 1. The method of miming the necessary finances to meet the cost of operating the said area planning commission, shall be by contribution as agreed upon, by the cities and county on the basis 2 of the following percentages of the total necessary contributions. San Joaquin bdi, Stockton 25% Lodi W4 Tracy Manteca 4% Ripon 2, Escalon kT. All contributions shall be paid to San Joaquin County. 2. The yearly budget of the Commission shall be prepared by the Cossiission. for adoption by each city and county. 3. The Commission is empowered to receive gifts and grants, including all State and Federal funds available for the purpose for which the Cgmmis■ion exists, and to contract with the State of California, the United States, and other agencies with respect thereto. The Commission shall be prepared, within the limitations of its budget, to provide matching funds, wherever grants, gifts or bequests are obtainable on that basis. 4. The Commission say adopt Sy -laws subordinate hereto for it. appropriate self-government. S. San Joaquin County shall act as controller and Auditor of all funds under the jurisdiction of the Commission. V. By passing this resolution each of said co-operating Cities and County adopt said "Operating Contract for the San Joaquin Area Planning Commission" and authorise ite chief officer to sign the same. 3 VI. Aaasiadasnts 1. Amendments of those Articles of Organisation may be made by legislative resolution of three-fourths of the somber Cities and County. WITlaSSatss THAT WHEREAS, purauant to Oa provisions of Section 66090 and following of tate GOVOMIMMIA Code of the State of California, the parties hereto haw heretofore by Joint resolution established and created an Area Planning Commission designated as the San Joaquin Area Planning Cosmmissioa; and WHER3AB, the parties hereto are desirous of entering into a ooatraot providing for the operation of said area planning commis- sion, including the employment of personnel, consultants and apn- cialiata by contract and a plan for organisation and financing said commission is accordance with Section 860@4 of the Government Code; HOW, THEREPOR3, to that end the parties hereto have and by these presents do agree as foliowas 1, Territory BilAgq4• The area mubjeot to the operations of the San Joaquin Area Planning Commission shall he the entire area gaoeelpassed by the exterior houndarlea of said county. 2, Seco. and Poring, of Amtivit$$g. The budget proposed by the Commission and adopted or approved by the Board of Supervisors and peroemtage of contribution of funds therefore for any fiscal year will be as is mutually agreed upon between the parties hereto. 4. pereceeel. .It is agreed that the Commission may tram time to time employ professional asslstants or expert consultants on a contract basis at's salary or fee agreed upon by the Commission and the coatraptors. All other full time personnel exclusively serving 2 said Commission shall be employed by the County of San Joaquin with - la the planning department of said vausty. Such employees shall be subject to the Civil Service provisions of the County of San Joa- quin and shall be employed as nearly as possible upon a salary range applicable to other minty employees doing the same or simi- lar work. Such employees shall have all of the benefits of and be subject to the provisions of the Employee Retirement Association and Salary Ordinance of the County of San Joaquin, With the approv- al of the Area Planning Coomissiob, the Planning Srpartnents of the respective parties hereto may from time to time amigo regular per- sonnel of said departments to perform serviass for the Area Plan- ning Commission upas a part time or temporary basis, and the salary of such employees during the time they are so serving shall be chargeable. against the funds of the Area Planning Commission. 5.
