RESOLUTION NO. 200Q
RESOLUTION OF THE CITY OF LODI, RhQ'UESTING AN AMEND-
NIENT TO SECTION 1925.1 OF THE STREETS AND HIGHWAYS
CODE OF THE STATE OF CALIFORNIA PERTAINING TO THE:
VOTE REQUIRED FOR DISSOLUTION OF LIGHTING DISTRICTS
FORMED PURSUANT TO THE HIGHWAY LIGHTING DISTRICT ACT
OF THE STATE OF CALIFORNIA.
WHEREAS, the Ripon Lighting District was formed by the
Board of Supervisors of San Joaquin County on August 30, 1915
and since said date has been in existence for the purpose of
furnishing street lighting to the residents of the Ripon area;
and
WHEREAS, the City of Ripon, a Municipal Corporation of

the Sixth Class of the State of California, has subsequently
been established in the Ripon area and presently encompasses
within its Cita limits a majority of the area within the said
Ripon Lighting District; and
WHEREAS, the City Council of the City of Ripon is willing
to assume the obligation of furnishing street lighting to the
residents of the Ripon Lighting District; and
WHEREAS, since 1948 efforts have been made to secure a
dissolution of said district by all interested parties; and
WHEREAS, in 1955 an election was held pursuant to the pro-
visions of Section 19000 et seq., of the Streets and Highways
Code of the State of California for the purpose of securing a
dissolution of said lifrhti.nf district; and
WHEREAS, pursuant to the provisions of Section 1925.1 a
two-thirds vote of the qualified electors of the district 9-s
necessary to effect a dissolution; and.
WHEREAS, all efforts to secure such a two-thirds majority
of the qualified electors of the district in favor of the
dissolution has been impossible to secure and it is the consensus
of opinion of all interested parties that said two-thirds re-
quirement is an impossible plurality to secure; and
WHEREAS, it appears that remLdial legislation amending
Section 19251 of the Streets and Highways Code to require a
simple majority of the votes cast at any election for dissolu-
tion is a more reasonable and logical requirement for Phe dis-
solwtion of a highway lighting district formed pursuant to the
provisions of Section 19000 et seq., of the Streets and High-
ways Code; and
WHEREAS, it is felt that it would be to the benefit and
best interests of all districts in the State of California
formed pursuant to Section 19000, et seq., of the Streets and
Highways Code if such an amendment was effected to Section
19251 as to the vote required to effect a dissolution;
NOW, THEREFORE, BE IT RESOLVED BY the City Council of the
City of Lodi that said City of Lodi does hereby go on record
in favor of an amendment to Section 19251 of the Streets and
Highways Code of the State of California amending said section
to require a simple majority of the votes cast at a district
election in favor of dissolution to effect a dissolution of a
highway lighting district formed pursuant to the provisions
of Section 19000., et seq., of the Streets and Highways Code
pertaining to highway lighting districts;

of Lodi does hereby respectfully request its duly elected rep-
resentatives to the Legislature of the State :of ..Galiforni.a to
tate such steps as may be necessary to'effect such an amendment
to. th e,.provi®ions o f the Streets and Highways Code pertaining
to the dissolution of a highway lighting district formed pur-
euant.to the provisions of Section 19000 et seq., of the
CERTIFIED to be a full, true and correct
copy of Resolution No. 2000 of the City
Council of the City of Lodi as passed and
adopted in regular meeting held February
6, 1957.

Gentleman:
Mayor Harvey R. Latscha has asked this office to
express his thanks and appreciation upon behalf of the City
Council, for your fine response to our request relative
to possible dissolution of Ripon Lighting District.
For your information our Assemblyman Mr. William
Biddick has introduced AB 2229 into the current legislative
session. And by coincidence I just received this morning
a -notice the hearing upon same will be hold Tuesday, March
26 at 8:00 P.M. in Sacramento. I am not suggesting you or
your City do anything Rather about this (natter, as I pre-
sume that is well arranged for between the Mayor and City
Attorney.
