RESOLUTION NO. 1999
WHEREAS, two certain deeds described as follows:
1. Deed dated December 28, 1956, by William A.
DePauli and Rose M. DePiuli, hi* wife to the City of Lodi,
granting the westerly 10 feet of the 35 feet required by the
city;
2. Deed dated December 28, 1956, by William A.
RiefFauAlt, Joseph B. DePauli and Marie Vlasich, aka Marie N.
Vlasich and Mary N. Vlasich, to the City of Lodi, granting
the easterly 25 feet of the 35 foot atr*p required by the
city;
which deeds, cozdunctively, convey the fee title to a strip
of land 35 feet gide running -par lel to the center line of
Hutchins Street and extending 2314 feet, more or leas, along
the easterly line of the property','bf William A. DePauli and Rose
M. DePauli in the northeast 'quarehr of Section 11, T. 3 N.,
R. 6 E., MDBM, necessary for the Widening of Hutchins Street;
have been deposited by the grantors therein named with Robert
H. Muller,, City Attorney, upon the condition that said deeds
shall be delivered to the City Clerk for the benefit of the City
of lindi when and after,by appropriate action, the City Council
shall"duly and regulary declare in the terms as hereinafter
resolved, and
WHEREAS, it is to the advantage and best interests of,
and in accord with established policy of the City of Lodi that
said coalition be net by the adoption of this resOlution as
the cOnaideration for the execution of said deeds;
NOW, THEREFORE, BE IT RESOLVED:
Section 1. That the land described in said deeds be,
and the same is hereby, dedicated to public use as a portion
of Hutchins Street in the City of Lodi;
Section 2. That, in consideration of the execution
and delivery of said deeds, the City of Lodi will peer, or cause
to be paid, the costs and expenses of *11 p:;bl,ic imtrovements
now or hereafter made or done and/or use made of thi land des-
cribed in said deeds,including, but not limited to, the con-
struction and instalation of curbs, gutters, sidevalks and street
improvement and poring, and that the City of Lodi will forever
hold -William A. bePi.*11 Mose M. DePauli and their heirs,
executers, etniniatretors assigns and their real property
fronting on Hutchins Street, free *ad clear of all assessments
acrd/or taxes, liens and/or encumbrances by reason of any public
work or improvement, except a lighting district, in and/or
upon, or by reason of any public use of, the land described in
said deeds or any part of Hutchins Street adjacent thereto.
I HERBY CERTIFY that the foregoing is a
true and correct copy of Resolution No. 1999
passed and adopted by the City Council of the
City of Lodi in regular meeting held February 6,
1957.
