RESOLUTION NO. 1950
APPROVING THE PURCHASE OF CERTAIN FACILITIES
FROM THE PACIFIC GAS AND ELECTRIC COMPANY
AND AUTHORIZING EXECUTION OF A LEASE FOR THE
PREMISES INVOLVED THEREWITH.
WHMAS, a contract by and between, the City of Lodi and
the Pacific Gas and Electric .Company covering the purchase of
electricity by the City From Pacific for a period of seven
years ending August 27, 1962 has been approved by the Public
Utilities Commission of the State of California pursuant to
its Decision No. 52627, and
WHEREAS, said contract as approved contains an Addendum
setting forth the conditions of delivery, one of which con-
ditions requires that at some reasonable time after August
27, 1956, the City shall either purchase certain .facilities
owned by Pacific and used in the transmission of electricity
from Facificxs Lodi Substation to the Cityts substation at
the fair market value thereof, or shall make other arrange-
ments for said transmission, and
WHEREAS, representatives of the City and Pacific have
agreed after careful study and discussion that the sum of
$55,834.00 plus Municipal and State sales taxes of $2,233.36
represents the fair market value of said facilities, and
WHEREAS, the City Council hereby finds and determines
that said agreed value is less than, the amount necessary to
provide arrangements for an alternative service, and that the
purchase of said facilities from Pacific is accordingly in the
best interests of the City, and
VEMTEAS, by its letter of July 3� 1956, Pacific has
offered to tell and transfer said facilities to the City for
tke total sum of 558,067.36, sales taxes included} and to
lease the ground area in Pacificts substation yard occupied
by the station equipment included in said facilities for the
sum of $1.00 per year to the City, with the understanding that
said area .will be fenced off by the City from the remainder
of Pacific's substation property and provided with separate
access, now, therefore,
BRIT BESOLVED, that the offers so made by Pacific are
hereby accepted, and the Mayor is hereby authorized and
directed to execute such documents as may be necessary to
complete said purchase and said lease.
