RESOLUTION NO. 1942
A RESOLUTION OF APPROVAL AND AGREEMENT TO TERMS
OF PETITION FOR THE FORMATION OF PARKING DISTRICT
NO. 1, AND DIRECTING PREPARATION OF REPORT
PARKING DISTRICT NO. 1
RESOLVED, by the City Council of the City of Lodi, Cali-
fornia, that
WHEREAS, a verified petition for the acquisition and im-
provement of certain parking places within proposed Parking Dis-
trict No. 1, therein more particularly described, has been cir-
culated and filed in the office of the City Clerk on Monday,
June 18, 1956;
WHEREAS, it is proposed that the proceedings contemplated
by said petition be conducted pursuant to the Parking District
Law of 1951, Part 4, Division 18, comprising Sections 35100
to 35706, inclusive, of the Streets and Highways Code, as amended,
Section 35254 of which Code provides that if the petition proposes
a contribution of money by the City the legislative body either
shall reject the petition or shall agree to make the contribution
specified, and Section 35256 of said Code provides that if the
petition proposes that the City continue to maintain parking
meters on public ways within the District, the legislative body
either shall reject the petition or shall agree to continue to
maintain the parking meters as proposed;
WHEREAS, said petition proposes that the City continue to
maintain parking meters on the following public ways, both within
and without the boundaries of the proposed Parking District, but
within the Central Business District of the City, to wit: Both
sides of Sacramento Street from Locust Street to Walnut Street;
School Street from Locust Street to Walnut Street; Church Street
from Elm Street to Oak Street; Locust Street from railroad tracks
to School Street; Elm Street from railroad tracks to Church
Street; Pine Street from Sacramento Street to Pleasant Avenue;
Oak Street from Sacramento Street to Church Street and Walnut
Street from Sacramento Street to Church Street, all as shown on
the map of the City of Lodi and vicinity, San Joaquin County,
California, on file in the offices of the City Clerk and the City
Engineer of the City of Lodi.
WHEREAS, said petition proposes that said parking meters
be maintained as long as any of said bonds or interest thereon
remain unpaid, subject to the provisions of said Law relating to
the elimination of parking meters or any thereof, and that the
City shall also install and maintain parking meters on other such
public ways within the Parking District or outside the Parking
District as the City Council shall from time to time find and
determine that the public interest, convenience and necessity
require to be installed and maintained;
WHEREAS, said petition further proposes that the City shall
pledge and shall annually allocate all of the annual net revenues
of the on -street parking revenues to be received by it from
the parking meters now or hereafter located on the streets above
described, and the net revenues to be received by it from the
off-street parking facilities to be acquired from the proceeds
of said bonds, to the payment of the principal of and interest
on the parking bonds to be issued herein.
WHEREAS, the City Clerk has examined said petition and
has certified to this Council that said petition is signed by
the requisite number of qualified signers and is sufficient;
NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED and
ORDERED, as follows:
1. That the petition for the formation of Parking District
No. 1 filed in the office of the City Clerk on June 18, 1956, be,
and it is hereby approved.
2. That said petition has been signed by the owners of
real property in the proposed district who appear to be such on

the last equalized assessment roll used by the City of Lodi for
purposes of City taxation, owning real property of an assessed
value of not less than fifty-one per cent (51%) of the total
assessed value of all taxable real property in the proposed dis-
trict as shown by the assessment roll, and owning taxable land
in the proposed district constituting not less than fifty-one per
cent (51%) of the total area of all taxable land therein, and
that said petition is sufficient.
3. That the public interest, convenience and necessity
require, and the City Council hereby agrees, that parking meters
be continued to be maintained as proposed in the said petition.
4. That the City Council hereby agrees to pledge and an-
nually allocate all of the annual net revenues of the on -street
parking revenues to be received by it from the parking meters
now or hereafter located on the streets above described, and the
net revenues to be received by it from the off-street parking
facilities to be acquired from the proceeds of said bonds, to the
payment of the principal of and interest on the parking bonds to
be issued herein.
5. That the firm of Harold F. Wise, Associates, Planning
Consultants, be, and they are hereby, directed to make and file
with the City Council a report showing the following:
(a) An estimate of the cost of the acquisitions and
improvements proposed by the petition and of the incidental ex-
penses in connection therewith and of the proceedings therefor;
(b) An estimate of the annual revenues which can be
expected to be derived from the operation of the proposed parking
places, and of the annual expenses of operating and maintaining
the parking places exclusive of principal and interest on the
bonds to be issued;
(c) An estimate of the annual net revenues which can
be expected to be derived from the parking meters, the revenues

from which are by the petition proposed to be pledged to any of
the purposes specified in the Parking District Law of 1951.
(d) The total assessed value of the real property
within the proposed district as shown on the last equalized as-
sessment roll.

1 hereby certify that the foregoing resolution was duly
and regularly adopted and passed by the City Council of the City
of Lodi, California, at a regular meeting thereof held on the
18th day of July, 1956, by the following vote:
