HomeMy WebLinkAboutResolutions - No. 1875In the City Council City of Lodi Lodi, California RESOLUTION NO. 1875 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI GIVING NOTICE OF Tilt PROPOSED ANNEX- ATION OF THE HEREINAFTER CRIBED TERRITORY DESIGNATED A8 "3AA ADDITION" TO THE CITY OF LODI WHEREAS, under the provisions of that certain Act of the legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", proceedings for the annexa- tion to the City of Lodi of the territory hereinafter particularly described have been initiated by the filing of a petition for annexation to the City of Lodi of the territory hereinafter described by the owners of not less than one-fourth of the land, both by area and assessed value, in said territory proposed to be annexed, and WHEREAS, the a*$erior boundaries of said territory described in said petition and which territory is contiguous to the limits of the City of Lodi, San 'Joaquin County, State of California, are described as follows: Beginning at the southwest corner of Section 12, T. 3 N., R. 6 E., Mount Diablo Base and Meridian, thence North 00 58g 15" East along the west line of said Section 12, 25.03 feet more or less to the north line of Kettleman Lane, thence North 88° 05* 30" Eaat along the north line of Kettleman Lane, being the present boundary line of the City of Lodi, 23+0.03 feet, thence leaving the present boundary of the City of Lodi South 00 42' 45" rest, parallel to the west line of Section 13, T. 3 N., R. 6 E., Mount Diablo Base and Meridian, 225.03 feet, thence South 88'° 054 30" West 1. parallel to the north line of said Section 13 a distance of 2+0.14 feet more or leas to the west line of said Section 13, thence North .0° 421 4+5" Wast along said west line 200.00 feet more or less to the point of beginning, containing 1.24 acres, more or less. WHEREAS, the aforesaid petition for annexation of the terri- tory hereinbefore described to the City of Lodi, a municipal corporation, has been filed with and received by the Council of the City of Lodi, and WHNSEAS, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the provisions of the Annexation of Uninhabited Territory Act of 1939, and WHREAS,the boundaries of said territory were submitted to the Boundary Commission of San Joaquin County on June 14, 1955, and since more than 20 days have elapsed without a report from that body, the boundaries are presumed definite and certain, now therefore BM IT RESOLVED, as follows: 1. That the City Council of the City of Lodi does by this resolution give notice of such proposed annexation; does hereby designate said territory as "Barbera Addition; and, further, does fix Wednesday, September 7, 1955, at the hour of 3:00 o'clock p.m., at the City Council Chambers, City Hall, Lodi, California, as the day, hour and place when and where any person owning real property within such territory so propds4 to be annexed and having any objection to the proposed annexation may appear before the City Council and show cause why such territory should not be so annexed. 2. 2. That the Clerk of the City of Lodi be, and he is here- by directed to cause a copy of this resolution to be published at least twice in the "Lodi Hews -Sentinel", a newspaper printed, published, and circulated in the City of Lodi, the municipal corporation to which it is proposed to annex the hereinbefore described territory, and at least twice in the "Stockton Record", a newspaper printed, published, and circulated outside the City of Lodi, all in the time, form and manner required by law. 3. That at any time not later than the hour set for hearing objections to the proposed annexation, any owner of property within the territory proposed to be annexed may file written protest against the proposed annexation; that such protests shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms. ** ** ** ** Certified to be a full, true and correct copy of Resolution No. 1875 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held August 3, 1955.
