HomeMy WebLinkAboutResolutions - No. 1873In the City Council City of Lodi Lodi, California RESOLUTION NO. 1873 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE THAT PORTION OF FALLS AVENUE IN THE SCHNEIDER TRACT BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: Section 1. It is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and highways Code of the State of California, to vacate, close, and abandon as public street the following street situated in the City of Lodi, County of San Joaquin, State of California, more particularly described as follows: Falls Avenue from the west line of Grant Avenue to the east line of Roper Avenue as delineated on the Official Map of Schneider Tract filed October 25, 1949, in Vol. 13, at page 51, Book of Maps and Plats, San Joaquin County Records, excepting therefrom the 50 by 40 foot area lying within the intersection of Falls Avenue and Crescent Avenue. Reference is hereby made to a map or plan on file with the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. Section 2. The City Council of the City of Lodi does hereby find that public convenience and necessity require the reservation and exception from said vacation of the permanent easement and right at any time to maintain, operate and construct lines of pipe, conduit, cables, poles, equipment and fixtures for the operation of water, sewer, gas, telephone, and electric lines -1- now located in or to be located within said area of Falls Avenue and which reservations and exceptions are described as follows: 1. A ten foot area, the center line of which lies 124 feet westerly of the west line of Grant Avenue and lies parallel thereto, and being the northerly extension of the existing utility easement reserved lying between lots 1 and 9 al shown on said map of Schneider Tract. 2. A ten foot area, the center line of which lies 125 feet westerly of the west line of Crescent Avenue and lies parallel thereto, and being the northerly extension of the existing utility easement reserved lying between lots 10 and 21 as shown on said map of Schneider Tract. 3. The south three feet of Falls Avenue from the west line of Grant Avenue extending westerly to the wtdt line of Crescent Avenue. These proceedings are taken subject to such.'reservations and exceptions. Section 3. NOTICE IS HEREBY G1'EN that this City Council does hereby fix WEDNESDAY, SEPTEMBER 7, 1955, at the hour of $:00 o'clock p.m. and the CITY COUNCIL CHAMBERS, CITY HALL, LODI, CALIFORNIA, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before this City Council and be heard. Section 4. Upon adoptidn of this restention the Superintendent of Streets shall post, or cause to be posted, notice of such passage and of the time and place set herein for public hearing, in modules with And in LURA, TOM and unnar as proscribed by law for t e vee tion of public streets. Section 5.
