HomeMy WebLinkAboutResolutions - No. 1818In the City Council City of Lodi Lodi, California RESOLUTION NO. 1818 GIVING NOTICE OF THE PROPOSED ANNEeATION OF TERRITORY TO THE CITY OF LODI AND OF THE TIME AND PLACE FOR THL HEARING OF PROTESTS AGAINST SUCH ANNEXATION WHEREAS, the hereinafter described property, constituting a portion of a major street, is contiguous to the City of Lodi, an d WHEREAS, the health and safety of the community requires that the City of Lodi exercise reasonable police control over said major street, and WHEREAS, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the provisions of the Annexation of Uninhabited Territory Act of 1939, and WHEREAS, the certainty and definiteness of the boundaries of the proposed annexation were approved by the CountY Boundary Commission on February 11, 1954, now therefore BE IT RESOLVED, that the City Council of the City of Lodi does hereby initiate proceedings and declare its intention to annex to said City, in accordance with the provisions of the Annexation of Uninhabited Territory Act of 1939, as amended, that uninhabited territory in the County of San Joaquin, State of California, described as follows: A portion of the Northwest (uarter of Section 12 and a portion of the Northeast Quarter of Section 11, Town- ship 3 North, Hange 6 East, Mount Diablo Vase and Meri- diani, more particularly described as follows: Commencing at a point -on the south line of the Northeast C,uartor of said Section 11, 25 feet westerly from the Southeast corner of said Northeast Quarter, which point is also on the present b:undary line of the City of Lodi, and running ee.sterly along said boundary line to the corner of said City boundary, which corner is 30 feet, more or less, easterly from the west line of the Northwest Quarter of said Section 12; thence northerly along said City boundary line to a point, which point is 454.4 feet southerly and 30 feet easterly from the Northwest corner of said Northwest Quarter, said point being also a corner of said City boundary line; thence westerly along said City boundary line a dis- tance of 55 feet, more 'or less, to a point which is 25 feet westerly of the east line of said rection 11; thence south and parallel to said east line to the point of beginning, containing 2.76 acres, more or less. Reference is hereby made to a reap or plat on file in the office of the City Clerk of this City delineating the boundaries next above described. BE IT FURTHER RESOLVED, that said territory be designated "SOUTH HUTCHIT;S bTREET AiJDITION" as an appropriate name to be used iri reference to said territory further in these pr•occedings. Attention is directed to Section 35312 of the Government Code of the State of California relative to protests. BE IT FURTHER RESOLVED, that the City Clerk of the City of Lodi shall cause a copy of this resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation published outside of the City in the County iri which is located the territory proposed to be annexed; pub- lication to be completed at least 20 days prior to date set for hearing as required by Section 35311 of the Government Code of this State.
