HomeMy WebLinkAboutResolutions - No. 1778 ERIn the City Council City of Lodi Lodi, California RESOLUTION NO. 1778 CALLING A SPECIAL ELECTION TO'BE HELD UN THE 15th DAY OF DECEMBER, 1953, PERTAINING TO THE ANNEXATION OF SUNSET ADDITION TO THE CITY OF LODI WHEREAS, by Resolution No. 1771, the City Council of the City of Lodi declared its intention to call a special election in certain inhabited territory contiguous to said city proposed to be annexed to said city, for the purpose of submitting to the qualified electors residing in said territory the question of whether or not said territory shall be annexed to said city; and WHET -SEAS, a copy of said resolution was published as required by law; and WHEREAS, at a time not later than the hour set by said reso- lution for hearing objections to the proposed election no written or oral protests were :Lade by owners of a majority of separate parcels of property within the territory proposed to be annexed, and WHEREAS, all proceedings have been had in accordance with said resolution and the Annexation Act of 1913, reference thereto hereby being made for further particulars; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi as follows: Section 1. A special election hereby is called to be held on the 15th day of December, 1953, in the territory hereinafter described and proposed to be annexed to the City of Lodi., for the purpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be annexed to, incorporated in, and made a part of said City of Lodi. Said territory is described as follows: A portion of the Northeast Quarter of Section 11, T3N, R6E, M.D.B.&M., .;)an Joaquin County and being more parti- cularly described as follows: Beginning at a corner of the present City boundary line, which corner is also the point of intersection between the south line of West _.odi Avenue and the west line of the Northeast Quarter of said Section 11, and running easterly along the City boundary line 438.22 feet, more or less, to the northwest corner of Lot 1 as said lot is designated on map entitled "Walnut Addition", filed March 1, 1920, in Vol. 9 tt page 75, Book of Maps and Plats, San Joaquin County Records; thence southerly along the City boundary lirie.and the west line of said Lot 1 a distance of 196.8 feet, more or less, to the southwest corner of said Lot 1, which point is also a ,corner of the City boundary line; thence easterly along the south line of Lots 1, 2, and 3 of said Walnut Addi- tion and its easterly projection, said line being also a boundary line of the City of Lodi, a distance of 279.11 feet, more or less, to its intersection with the east line of Fairmont Avenue,which line is also a boundary line of said City; thence southerly along said east line and City boundary line a distance of 922.49 feet; thence westerly and parallel to the northline of said quarter section a distance of 717.3 feet, more or less, to the west line of said quarter section, which line is also a City boundary line; theme* northerly along said west line and City boundary line a distance of 1321.29 feet, more or less, to the point of beginning, containing 17.19 acres, more or less. SECTION 2. TIME OF OPENING AND CLOSING POLLS. The polls at said election shall be opened at 7 o'clock a.m. of the day herein fixed for the holding os said election and shall be kept open until 7 o'clock p.m. of the same day, when the polls shall be closed. SECTION 3. BALLOTS. Upon the balots to be used at said election there shall be printed the words: SHALL SUNSET ADDITION BE ANNEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF LODI? Opposite these woras there shall be printed the words "Yes" and "No", and to the right of each of these last two words there shall be voting square. If an elector shall stamp a cross (4-) in the voting square after the printed word 11o0 the ¥Q4, Qi. such elector shall be counted in favor of the annexation of said territory to the City of Lodi; and if an elector shall stamp a cross (--) in the voting square after the printed word "No" the vote of such elector shall be counted against such annexation. In all particulars riot herein recited said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. SECTION 4. (a) For the purpose of said election there hereby is established in the territory described herein one (1) voting precinct, which shall include all of said territory. The following is the polling place of said election precinct and the following named persons hereby are named officers of election and shall constitute the board of election for such election precinct: Polling Place: 1216 West Lodi Avenue San Joaquin,County, California Inspector: Mrs. Helen K. Rencher Judge: Mrs. Josie B. Culbertson Clerks: Mr. John A. Babish Ors. Alma L. Nagel (b) For their services in connection with said election, said inspector shall receive $12.00 and said judge and clerks $10.00 each; and the person in possession of the polling place named herein shall receive for the use of such premises in con- nection with said election the sum of $10.00. SECTION 5. The Gity Clerk shall publish a notice of said special election as required by said Annexation Act of 1913, at least once a week for the four (4) weeks prior to the date of the election on December 15, 1953, in the Stockton Record, a news- paper of general circulation printed and published outside the City of Lodi but in the County of San Joaquin, California. 0 Certified to be a full, true and correct copy of Resolution No. 1778 passed by the City Council of the City of Lodi in a regular meeting held November 4, 1953. ity Clerk C/
