RESOLUTION NO. 1771
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LODI DECLARING ITS INTEN'T'ION TO CALL A SPECIAL
ELECTION IN CERTAIN INHABITED TERRITORY CONTIGU-
OUS TO SAID CITY PROPOSED TO BE ANNEXED THERETO,
FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS RESIDING IN SAID TERRITORY THE QUES-
TION WHETHER OR NOT SAID TERRITORY SHALL BE
ANNEXED TU THE CITY OF LODI, AND FIXING A TIME
AND PLACE WHEN AND WHERE ANY PERSON OWNING REAL
PROPERTY WITHIN SUCH TERRITORY MAY AF,PEAR BEFORE
SAID CITY COUNCIL AND SHOW CAUSE WKY SUCH TERRI-
TORY SHOULD NOT BE SO ANNEXED (SUNAT ADDITION)
BE IT RESOLVED by the City Council of the City of Lodi:
SECTION 1. That it is the intention of the City Council
of the City of Lodi to call a special election to be hold on
the lst. da of December, 1953, in certain inhabited territory
contigUous o said city, proposed to be annexed thereto, for
the purpose of submitting to the qualified electors residing
in said territory the question whether or not said territory
shall be annexed to the City of Lodi and the property in the
territory subjected to taxation after annexation equally with
property within the City of Lodi..
Said territory is described as follows:
A portion of the Northeast Quarter of Section 11, Town-
ship 3 North, Range b East, Plount Diablo Base and Dieri-
dian, San Joaquin County and being more particularly
described as follows.
Beginning at a corner of the present City boundary
line, which corner is also the point of intersection
between the southline of West Lodi Avenue and the west
line of the Northeast Quarter of said Section 11 and
running easterly along the City boundary line 43A.22,cf`eet
more or less, to the northwest corner of Lot 1 as said
lot is designated on map entitled "Walnut Addition",
filed Larch 1, 1920, in Vol. 9 at page 75, Books of Maps
and fats, San Joaquin county tieeorns; thence soutneriy
along the City boundary line and the west line of said
Lot 1 a distance of 198.$ feet, more or less, to the
southwest corner of said Lot 1, which point is also a
corner of the City boundary line; thence easterly along
the south line of Lots 1, 2, and 3 of said Walnut Addi-
tion and its easterly projection, said line being also
a boundary line of the City of Lodi, a distance of 279.11
feet, more or less, to its intersection with the east
line of Fairmont Avenue, which line is also a boundary
line of said City; thence southerly along said east line
and City boundary line a distance of 922.49 feet; thence
westerly and parallel to the north line of said quarter
section a distance of 717.3 feet, more or less, to the
west line of said quarter section, which line is also
a City boundary line; thence northerly along said west
line and City boundary line a distance of 1121.29 feet,
more or less, to the point of beginning, containing
17.19 acres, more or less.
SECTION 2. That said territory hereby is designated and
identified for such election purposes and for use upon the
ballots at such election as "Sunset Addition.*
SECTION 3. Notice hereby is given that on the 4th day
o f November, 1953, at the hour of 8:00 P.M., in the Council
Chamber of the City Hall of the City of Lodi, any person owning
real property within said territory so proposed to be annexed
and having any objection to the proposed annexation may appear
before said city council and show cause why such territory should
not be so annexed. Such protest must be in writing and shall
state the name or names of the owner or owners of the property
affected by such annexation and the location and area of such
property in general terms. If it be found that protest is not
made by owners of a majority of the separate parcels of pro-
perty within the territory proposed to be annexed, further
proceedings shall be taken in accordance with the law for the
holding of such special election.
SECTION 4. That the City Clerk shall certify to the
adoption of this resolution and cause the same to be published
in The Lodi News -Sentinel once a week for the two weeks prior
to the said hearing.
CERTIFIED to be a full, true and correct copy of Resolution
No. 1771 passed and adopted by the City Council of the City
of Lodi in regular meeting held October 7, 1953•
