HomeMy WebLinkAboutResolutions - No. 1747In the City Council City of Lodi Lodi, California REJDLUTION NO. 1747 ORDERING THE VACATION OF CERTAIN STREETS AND ALLEYS IN LAWRENCE HOMESTEAD ADDITION AND IN LAWRENCE HOME- STEAD ADDITION NO. 2, ALL IN THE CITY OF LODI WHEREAS, this City Council, acting in accordance with the provisions of Part 3 of Division 9 of the Streets'and Highways Code of this State (The Street Vacation Act of 1941), did on the 6th day of May, 1953, pass and adopt Ordinance No. 486, therein declaring the intention of said City Council to vacate certain streets and alleys in Lawrence Homestead and Lawrence Homestead Addition No. 2, all as particularly described in said Ordinance, and WHEREAS, notice of said intended vacation was regularly given by publication and by posting, both in time, form and manner as required by law as is evidenced by affidavits on file and of record in the office of the City Clerk of the City of Lodi, and WHEIEAS, in accordance with the provision stated in said Ordinance No. 486 and also contained in the posted notices of the adoption of said Ordinance, notice was given that a public hearing would be held before said City Council in the City Council Chambers, City Hall, Lodi, California beginning at $:00 0 clock p.rn. of Wednesday, June 3, 1953 where and when any person interested in or objecting to said alley vacation could appear and be heard in relation thereto, and WHEREAS at that time and place a public hearing was held and conducted and testimony for and against said vacation was received, the City Council of the City of Lodi did determine that said streets and alleys are unnecessary for the present or future public use (excepting certain easements for public utilities) and did so find and declare, now therefore BE IT RESOLVED that the following described streets and alleys are hereby ordered vacated, closed up and abandoned: Vine Street Willow Street 'That portion of 2iain Street lying North of Lawrence Ave. Almond Street, excepting the forth one-half of said Street which lies West of Stockton Street That portion of Lawrence Avenue lying East of Stockton Street. as all of said streets are designated on the map entitled, "Map of Lawrence Homestead Addition, which Map was filed April 5, 1920 in Vol. 10, page 5, Book of I.aps and Plats, San Joaquin County Records, and That portion of Washington Street lying North of Lawrence Avenue. That portion of Central Avenue lying North of Lockeford Street That portion of Main Street lying North of Lawrence Ave. Wilson Avenue. Almond Street, excepting the North one-half of that portion of said Almond Street lying West of Stockton Street. Pioneer Avenue. That portion of Lawrence Avenue lying East of Stockton treet. Those areas designated as "alley" lying within Blocks 7, 10, 11, 12, 15, 16, 17, 19, 20, 22, and 23 as all of said streets and alleys are designated on the reap entitled, "Map No. 2 of Lawrence Homestead Addition", which Map was filed August 10, 1922 in Vol. 10, page 59, Book of Maps and Plats, San Joaquin County Records. Reserving, however, and excepting from the vacation of said streets, the permanent easement and right therein to maintain, operate and construct lines of pipe, conduit, cables, poles, equipment and fixtures for the operation of water, sewer, gas, telephone, and electric lines now located in or to be located in the following described portions of said streets; 1. A 15 foot strip of land lying in that portion of i'4ain Street North of Lawrence Avenue and lying 7i feet on each side of the center line of said portion of Main Stre€t as said street is designated on the map entitled "Map of Lawrence homestead addition", which map was filed April 5, 1920 in Vol. 10, page 5, in Book of Maps and Plats, San Joaquin County Records. 2. A 15 foot strip of land lying in that portion of Main Street North of Lawrence Avenue and lying 71 feet on each side of the center line of said portion of t`ain Street as said street is designated on the raap entitled "Map No. 2 of Lawrence Homestead Addition", which nap was filed August 10, 1922 in Vol. 10, page 59, Book of Maps and Plats, San Joaquin County Records. BE IT FURTHER RESOLVED, that the City Clerk of the City of Lodi shall cause a certified copy of this resolution to be recorded in the office of the County Recorder as required by Section 6324 of the Streets and Highways Code of the State of California. CBfC1'IFIED to be a full, true and correct copy of Resolution No. 1747 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held June 3, 1953. •
