RESOLUTION NO. 1740
ORDERING THE VACATION OF THAT PO4TIUN
OF THE ALLEY LYING BETWEEN LOTS 2 AND
3, BLOCK 6 OF THE CITY OF LODI
WHEREAS, this City Council, acting in accordance with the
provisions of Part 3 of Division 9 of the Streets and Highways
Code of this State (The Street Vacation Act of 1941), did on
the 18th day of March, 1953, pass and adopt Ordinance No. 470,
therein declaring the intention of said City Council to vacate
that portion of the alley lying between Lots 2 and 3, Block 6,
City of Lodi, all as particularly described in said Ordinance,
and
WHEREAS, notice of said intended vacation was regularly
given by publication and by posting, both in time, form and
manner as required by law as is evidenced by affidavits on file
and of record in the office of the City Clerk of the City of Lodi,
and
WHEREAS, in accordance with the provision stated in said
Ordinance No. 4.70 and also contained in the posted notices of the
adoption of said Ordinance, notice was given that a public
hearing would be held before said City Council in the `.ity Council
Chambers, City Hall, Lodi, California beginning at 8:00 o'clock
p.m. of Wednesday, April 15, 1953 where and when any person
interested in or objecting to said alley vacation could appear
and be heard in relation thereto, and
WHEREAS, at that time and place a public hearing was held
and conducted and testimony for and against said vacation was
received, the City Council of the City of Lodi did determine that
said alley was unnecessary for the present or future public use
(excepting an easement for public utilities) and did so find and
declare, now therefore
BE IT RESOLVED, that the following described alley is
hereby ordered vacated, closed up and abandoned:
The East 10 feet of Lot 2 and the West 10 feet of
Lot 3 in Block 6 in the City of Lodi, as said lots
and block are delineated and so designated upon that
certain Map entitled "Mokelumne" filed for record
August 25, 1$69 at 8:18 A. M., in Book of Maps and
Plats, Vol. 2, page 12, San Joaquin County Records.
Reserving, however, and excepting from the vacation of
said alley, the permanent easement and right therein to
maintain, operate and construct lines of pipe, conduit, cables,
poles, equipment and fixtures for the operation of water, sewer,
gas, telephone, and electric lines now located in or to be
located in the following described portion of said alley:
A strip of land 5 feet in width and 25 feet in length
more particularly described as follows:
Beginning at a point on the south line of Lot 3,
Block 6, of the City of Lodi, as said lot is designated
upon that certain kap entitled "Nlokelumne" filed for
record August 25, 1869 in book of Naps and Plats, Vol.
2, page 12, San Joaquin County Records, said point being
a distance of lU feet easterly from the Southwest
corner of said lot; thence northerly and parallel to
the west line of said lot a distance of 25 feet; thence
thence westerly and parallel to the south line of said
lot a distance of 5 feet; thence southerly and parallel
to the west line of said lot to the south line of said
lot; thence easterly along said south line to the point
of beginning.
BE 1T FURTHER RESOLVED, that the City Clerk of the City of
Lodi shall cause a certified copy of this resolution to be
recorded in the office of the County Recorder as required
by Section 8324 of 'the Streets and Highways Code of the State
of California.
Certified to be a Full, true and correct copy of
Resolution 1740 as:passed and adopted by the City
Council of the City of Lodi in regular meeting held
April 15, 1953,.all member -s present wid voting for
such adoption.
