HomeMy WebLinkAboutResolutions - No. 1738In the City Council City of Lodi Lodi, California RESOLUTION NO. 1738 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI GIVING NOTICE OF PROPOSED ANNEXATION OF THE HEREIN- AFTER DESCRIBED TERRITORY DESIGI'ATED AS "IREY ADDI- TION'TO ThE CITY OF LODI WHEREAS, under the provisions of that certain Act of the Legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", proceedings for the annexa- tion to the City of Lodi of the territory hereinafter particularly described have been initiated by the filing of a petition for annexation to the City of -Lodi of the territory hereinafter des- cribed by the owners of not less than one-fourth of the land, both by area and assessed value, in said territory proposed to be annexed, and W1EREAS, the exterior boundaries of said territory des- cribed in said petition and which territory is contiguous to the limits of the City of Lodi, San Joaquin County, State of Califor- nia, are described as follows: A portion of the Southwest Quarter of Section 2, Town- ship 3 North, Range 6 East, Mount Diablo Base and Meri- dian, San Joaquin County and more particularly des- cribed as follows: Beginning at a point on the east line of the South- west Quarter of said Section 2, said point being 798.64 feet southerly from the center of said Section 2, and running N 690 42 3/4' W along the north line of the south 23 acres of the east 33 acres of the Southwest Quarter of said Section 2 a distance of 546.25 feet, more or less, to the west line of the east 33 acres of the Southwest Quarter of said Section 2, said line being a boundary line of the City of Lodi; thence southerly along said City boundary line a distance of 614.79 feet, more or less, to the corner of said City boundary line; thence easterly along said City boundary line a dis- tance of 546.25 feet, more or less, to the east line of said Southwest Quarter, said east line being also a boundary line of said City; thence northerly along said east line a distance of 613.22 feet, more or less, to the point of beginning, containing 7.7 acres more or less. WHEREAS, the aforesaid petition for annexation of the territory hereinbefore described to the City of Lodi, a muni- cipal corporation, has been filed with and received by the Council of the City of Lodi, and WHEREAS, the San Joaquin County Boundary Commission has approved the description of the proposed annexation as to definiteness and certainty, and WHEREAS, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the provisions of the Annexation of Uninhabited Territory Act of 1939, now therefore, BE IT RESOLVED, as follows: 1. That the City Council of the City of Lodi does by this resolution give notice of such proposed annexation; does hereby designate said territory as T'Irey Addition"; and, further, does fix Wednesday, May 20, 19,3, at the hour of 6:00 o'clock p.m., at the City Council Chambers, City Hall, Lodi, California, as the day, hour, and place when and where any person owning real pro- perty within such territory so proposed to be annexed and having any objection to the proposed annexation may appear before the City Council and show cause why such territory should not be so annexed. 2. That the Clerk of the City of Lodi be, and he is, here- by directed to cause a copy of this resolution to be published at least twice in the "Lodi News -Sentinel", a newspaper printed, published, and circulated in the City of Lodi, the municipal corporation to which it is proposed to annex the hereinbefore described territory, and at least twice in the "Stockton Record", a newspaper printed, published, and circulated outside the City of Lodi, all in the time, form, and manner required by law. 3. That at any time not leer than the hour set for hear- ing objections to the proposed annexatj.on, any owner of property within the territory proposed to be annexed may file written pro- test against the proposed annexation; that such protests shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms. CERTIFIED to be a full, true and correct copy of Resolution No. 1738 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held April 15, 1953.
