HomeMy WebLinkAboutResolutions - No. 1721In the City Council City of Lodi Lodi, California RESOLUTION NO. 1721' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LODI GIVING NOTICE OF PROPOSED ANNEXATION OF THE HEREINAFTER DESCRIBED TERRITORY DESIGNATED AS "NORTHWEST ADDITION" TO THE CITY OF LODI WHEREAS, under the provisions of that certain Act of the Legislature of the State of California entitled "Annexation of Uninhabited Territory Act of 1939", proceedings for the annexa- tion to the City of Lodi of the territory hereinafter particularly described have been initiated by the filing of a petition for annexation to the City of Lodi of the territory hereinafter des- cribed by the owners of not less than one-fourth of the land, both by area and by assessed value, in said territory proposed . to be annexed, and WHEREAS, the exterior boundaries of said territory des- cribed in said petition and which territory is contiguous to the limits of the City of Lodi, San Joaquin County, State of California, are described as follows: A portion of the North half of Section 2, Township 3 North, Prange 6 East, Viiount Diablo Base and Meridian, San Joaquin County and being more particularly des- cribed as follows: Beginning at the point of intersection between the northerly boundary line of the right of way of the Wood- bridge Branch Line of the Southern Pacific Railroad Co. with the west line of the Northeast Quarter of Section 2, T3N, R6E, M.D.B& M. and running northwesterly on and along said northerly line of sai0railroad right of way, said line being also the boundary line of the City of Lodi, to its intersection with the northerly projection of the east line of the "Woodlake Tract", map filed August 13, 1916, in Vol. 11, page 116, Book of fyiaps and Plats, San Joaquin County Records, said point of intersection being a corner of said City boundary line; thence southerly along said projected east line of the Woodlake Tract, and along said City boundary line, to its intersection with the south line of the Southern Pacific Co., Woodbridge Branch Line railroad right of way, said point of intersection being a corner of said City boundary line; thence southeasterly along said railroad right of way, and along said City boundary line, to the northeast corner of Lot 13 of the Gerard Tract, map filed August 8, 1916, in Vol, g, page 62, Book of Maps and Plats, San Joaquin County Records, said corner being also a corner of said City boundary line; thence southerly along the east line of said Lot 13 and its southerly extension, said line being also the boundary line of the City of Lodi, to its inter- section with the south line of Lake Street; thence easterly along said south line of Lake Street to its intersection with the west line of the northeast Quarter of Section 2, m3N, R6E, thence southerly on and along the west line of said NE quarter to its in- tersection with the south line of West Lockeford St., which point is also a corner of the said City boundary line; thence easterly along said south line of nest Lockeford Street, said line being also the present City Boundary line, 432.6 feet, more or leas, to an iron rod at the corner of the present City boundary line; thence northerly along said City boundary line 30 feet., more or less, to the center line of West Lockeford Street; thence easterly along said center line, which line being also the boundary line of said City of nodi, to a corner of the present boundary line, which is also a point 760.32 feet, more or less, from the west line of the Northeast Quarter of said Section 2; thence northerly along the boundary line of the City of Lodi to its with the north line of said railroad right of way, which point is also a corner of the present City boundary line; thence southeasterly on and along said north line of the railroad right of way, which line is also the present City boundary line, to the southwest corner of the "Grant Avenue Addition", annexed to the City of Lodi on October 24, 1949, which point is also a corner of the present City boundary line; thence northerly along the present City boundary line, which line lies 7.5 feet westerly from and parallel to the east line of Tract 6 of Burr's Addition to Lodi, to its intersection with the south line of Louie Avenue, which point is also a corner of the present City boundary line; thence westerly along said south line of Louie Avenue and its westerly extension, said line being also the present City boundary line, to its intersection with the west line of the Northeast Quarter of said Section 2, which point is also a corner of the present City boundary line; thence southerly on and along the west line of said quarter section line of said Section 2, said line being also the present City boundary line, to its intersection with the northerly boundary line of the Southern Pacific Co., Woodbridge Branch Line railroad right of way and the point of beginning. Containing 43.94 acres, more or less. WHEREAS, the aforesaid petition for annexation of the territory hereinbefore described to the City of Lodi, a municipal corporation, has been filed with and received by the Council of the City of Lodi, and WHEREAS, the San Joaquin County Boundary Commission has approved the description of the proposed annexation as to definiteness and certainty, and WHEREAS, less than twelve registered voters reside within said territory thereby qualifying the territory for annexation under the provisions of the Annexation of.Uninhabited Territory Act of 1939, now therefore, BE IT.RESOLVED,.as follows: 1. That the City Council of the City of Lodi does by this resolution give notice of such proposed anpekation; does hereby designate said territory as "Northwest Addition"; and „ further, does fix Wednesday, April -.1, 1953, at the hour of $:,DO o'clock P.M.,aat the Council Chamber, City Hall, Lodi, California, as the day, hour, and place when and where any person owning real pro- perty within such territory so proposed to be annexed and having any objection to the proposed annexation may appear before the City Council and show cause why such territory should not be so annexed. 2. That the Clerk of the City of Lodi be, and he is, hereby directed to cause a copy of this resolution to be published at least twice in the Lodi News -Sentinel, a newspaper printed, published, and circulated in the City of Lodi, the municipal corporation to which it is proposed to annex the hereinbefore described territory, and at least twice in the Stockton Record, a newspaper printed, published, and circulated outside the City of Lodi, all in the time, form, and manner required by law. 3. That at any time not later than the hour set for hear- ing objections to the proposed annexation, any owner of property within the territory proposed to be annexed may file written protest against the proposed annexation; that such protests shall state the name or names of the owner or owners of the property affected thereby and the description and area of such property in general terms.
