RESOLUTION N0. 1693
GIVING NOTICE OF THE PROPOSED ANNEXATION
OF TERRITORY TO THE CITY OF LODI AND OF
THE TIME AND PLACE FOR THE HEARING OF
PROTESTS AGAINST SUCH ANNEXATION
WHEREAS, there has been filed with the City Council of
the City of Lodi a written petition containing a description of
uninhabited territory contiguous to the present boundaries of
said City of Lodi, and signed by not less than one-fourth of
the owners of land, both by area and by assessed value, requesting
that said uninhabited territory be annexed to and made a part of
the City of Lodi, and,
WHEREAS, the City Planning Commission of, the City of
Lodi did on July 14, 1952 recommend the annexation of said
uninhabited territory to the City of Lodi, and
WHEREAS, the certainty and definiteness of the boundaries
of the proposed annexation were approved by the County Boundary
Commission on August 7, 1952, now therefore,
BE IT RESOLVED, that it is the intention of the City
Council of the City of Lodi, to annex to said City, in accordance
with the provisions of the Annexation of Uninhabited Territory
Act of 1939, as amended, that uninhabited territory in the
County of San Joaquin, State of California, described as follows:
Lots 42, 43, 44, 45, 46, and'the nest 67 feet of Lot
41 as designated on the map entitled, "Gerard Tract",
which map was filed August 8, 1916, in Book of Maps and
Plats, Vol. $, page 62, San Joaquin County Records,
'except the North 30 feet of Lot 41.
Containing 9.2 acres, more or less.
Reference is here made to a map or plat on file in the
office of the City Clerk of this Gity delineating the boundaries
next above described.
RESOLVE, further, that said territory be designated
"45TH ADDITION, LOTS 41 THROUGH 4.6 OF THE GERARD TRACT" as an
appropriate name to be used in reference to said territory
further in these proceedings,
RESOLVED, further, and notice is hereby given that this
City Council has fixed WEDNESDAY, the 1ST DAY OF OCTOBER, 1952
at 8:00 o'clock p.m. of said day and THE CITY COUNCIL CHA BERS,
CITY HALL, LODI, CALIFORNIA as the time and place when and where
protests of owners of real property within the boundaries of the
territory proposed for annexation will be heard and considered.
Attention is directed to Section 35312 of the Government Code
of the State of California relative to protests.
RESOLVED, further, that the City Clerk of the City of
Lodi shall cause a copy of this Resolution to be published at
least twice, but not oftener than once a week, in a newspaper
of general circulation published in the City, and also in a
newspaper of general circulation published outside of the City
in the County in which is located the territory proposed to be
annexed; publication to be completed at least 20 days prior to
date set for hearing as required by Section 35311 of the
Government Code of this State.
I, HENRY A. GLAVES, JR., City Clerk of the City of
Lodi and ex -officio Clerk of the City Council of said
City, do hereby certify that the foregoing is a full,
true and correct copy of Resolution No. 1693 of the
City Council of the City of Lodi as regularil..y introduced,
passed and adopted in regular meeting held August 20,
1952, by the following vote:
AYES: Councilmen, Robinson, Minn, Richey, Preszler
and Haskell
NOES: Councilmen, one
ABSENT: Councilmen, None
