HomeMy WebLinkAboutResolutions - No. 1687In the City Council City of Lodi Lodi, California RESOLUTION NO.1687 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE THAT PORTION OF CEDAR AVENUE LYING BETWEEN LOTS 27 AND 28 OF THE LAKE HOME SUBDIVISION AND THAT PORTION LYING IN LAKE HOME SUBDIVISION NUMBER TWO WHEREAS, the owners of real property abutting on the street hereinafter described have petitioned this City Council that the same be vacated and closed up as a public street; and WHEREAS, the City Planning Commission of the City of Lodi has approved the vacation of said street and has so reported to this City Council; and WHEREAS, this City Council finds and determines that said street is unnecessary for present or prospective street purposes; NOW THEREFORE, the City Council of the City of Lodi resolves as follows: Section 1. That it is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Part 3 of Division 9 of the Str,eets and Highways Code of the State of California, to vacate, close as a public street and abandon the following described portion of Cedar Avenue; THAT PORTION OF CEDAR AVENUE LYING BETWEEN LOTS 27 AND 2$ ON THE 1VAP ENTITLED LAKE HOME SUBDIVISION, WHICH MAP WAS FILED MARCH 7, 1938, IN VOL. 11, PAGE 30 IN BOOK OF MAPS AND PLATS, SAN JOAQUIN COUNTY RECORDS, AND ALSO THAT PORTION OF CEDAR AVENUE ON THE MAP ENTITLED LAKE HOME SUBDIVISION NO. 2, WHICH MAP WAS FILED MAY 29, 1940, IN VOL. 11, PAGE 56 IN BOOK OF MAPS AND PLATS, SAN JOAQUIN COUNTY RECORDS. Reference is hereby made to a map or plat on file with the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. Section 2. The City Council of the City of Lodi does hereby find that public convenience and necessity require the reserva- tion and exception from said vacation of the permanent easement and right at any time to maintain, operate and construct lines of pipe, conduit, cables, poles, equipment and fixtures for the operation of water, sewer, gas, telephone and electric lines now located in or to be located in a fifteen foot area, the center line of which lies 164.7 feet south of the south line of Turner Road and lies parallel thereto; and the City Council of the City of Lodi does hereby reserve and except from said vacation of the above described street the easement and rights as set forth above. Section 3. NOTICE IS HEREBY GIVEN that this City Council does hereby fix WEDNESDAY, JULY 16, 1952, at the hour of $:15 o'clock p.m. and the CITY COUNCIL CHAMBERS, CITY HALL, LODI, CALIFORNIA, as the time and place when and where all persons interested in or objecting to the Vacation herein proposed may appear before this City Council and be heard. -2- Section 4. Upon the adoption of this resolution the Superintendent of Streets shall post, or cause to be posted, notice of such passage and of the time and place set herein for public hearing, in accordance with and in time, form and manner as prescribed by law for the Vacation of public streets. Section 5. This resolution shall be published one time in THE LODI TIMES, a newspaper of general circulation, printed and published in the City of Lodi, and shall be in force and take effect on its passage. 40 CERTIFIED to be a full, true and correct copy of Resolution No. 1687 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held June 18, 1952, by the following vote: AYES: Councilmen and Preszlet NOES: Councilmen None ABSENT: Councilmen None ty 'e and ex Clerk •f the City of the City of Lo cio uncil
