HomeMy WebLinkAboutResolutions - No. 1679In the City Council City of Lodi Lodi, California RESOLUTION NO.1679 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE AN ALLEY IN BLOCK SIX, LAWRENCE HOMESTEAD ADDITION. WHEREAS, a principal owner of real property abutting on that certain alley running North and South in Block 6, Lawrence Home- stead Addition, as•ahown.in Map No. 2 of said Addition, has petitioned this City Council that said alley be vacated and closed as a public street; and WHEREAS, the City Planning Commission of the City of Lodi approves the vacation of said alley; and WHEREAS, this City Council finds and determines that said alley is unnecessary fob" present or prospective street purposes; NOW, THEREFORE, the City Council of the City of Lodi does resolve as follows:. Section 1. That it is the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, to vacate, close as a public street and abandon that certain alley running North and South in Block 6, Lawrence Homestead Addition, as shown in Map No. 2 of said Addition. Reference is hereby made to a map or plat on file in the office of the City Clerk of the City of Lodi for par- ticulars as to the proposed vacation. Section 2. The City Council of the City of Lodi does hereby find that public convenience and necessity require the reservation and exception from said vacation of said alley of permanent ease- ment and right at any time to maintain, operate and construct lines of pipe, conduit, cables, poles, equipment and fixtures for the operation of water, sewer, gas, telephone and electric lines now located in or to be located in said alley, all as set forth in Section 8330 of the Streets and Highways Code; and the City Council of the City of Lodi does hereby reserve and except from said vacation the easement and rights as set forth above. Section 3. Notice is hereby given that this City Council does hereby fix Wednesday, June 18, 1952, at the hour of 8:15 p.m. and the City Council Chambers, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to the vacation herein proposed may appear before this City Council and be heard. From the evidence so submitted the City Council will make its election. Section 4.. Upon the adoption of this resolution, the Super- intendent of Streets shall post, or cause to be posted, "Notice of Street Vacation" in time, manner and contents as required by law. Section 5. This resolution shall be published one time in "The Lodi Times", a newspaper of general circulation, printed and published in the City of Lodi, and shall be in full force and effect on and after the twenty-first day of May, 1952.
