• RESOLUTION NO. 1604
APPROVING A REGULATION OF THE PENSION
BOARD RELATING TO PENSION CONTRIBUTIONS
DURING AND AFTER PERIODS OF EXTENDED
LEAVE
WHEREAS, It is recognized that certain questions relative
to operation of the City of Lodi retirement system will arise in
connection with voluntary and involuntary leaves of absence on the
part of the members thereof; now therefore,
BE IT RESOLVED, That any employee -member finding it necessary
to remain on leave without pay as a result of illness, any employee -
member ordered to military duty and any employee -member receiving
a leave without pay in accordance with the personnel rules and
regulations, shall have the following options:
1. He may elect to remove his contributions from the
Pension Fund, in which event upon his return from leave, he will
enter the pension system as a new member without credit for pre-
vious service.
2. He may continue to make monthly pension payments in
accordance with the salary and rate of contribution obtaining in
the last month immediately preceding such leave.
3. Upon return from leave, he may have deducted from his
salary currently required deductions for pension purposes, plus pay-
ments in accordance with the salary and rate of contribution obtain-
ing in the last month immediately preceding such leave until such
latter payments shall have reached the amount he would have con-
tributed had he been continuously employed; or, as an alternative
thereto, he may make such payments for the period of leave in one
lump sum or in such amounts as the City may reasonably determine.
This option must be exercised within ninety days after return from
leave. Payments made in reimbursement of contributions not made
during the period of leave shall be so arranged that full reimburse-
ment is made within a period not greater than twice the period of
absence on leave.
4. He may elect to make no payments for the period of
leave, in which event he shall receive no credit toward retirement
for the period of leave. This option shall be exercised within
ninety days after return from leave._
BE IT FURTHER RESOLVED, That such payments shall be without
interest chargeable by the City, and
BE IT FURTHER RESOLVED, That the City shall match any pay-
ments so made in the same manner as if such payments had been made
concurrently with the service of the employee -member and that the
employee -member shall thereby receive credit toward retirement as
if his service had been unbroken; and
BE IT FURTHER RESOLVED, That this determination shall be
liberally interpreted. It is the intent of the City Council that
no employee -member shall suffer, except at his own option, any
loss of retirement credit by reason of a regularly -granted leave
of absence, provided that the actuarial requirements of employee -
member and City contributions are met.
The foregoing Resolution No. 1604 adopted by the City
Council of the City of Lodi in regular meeting held
May 2, 1951, all members present and voting for such
adoption.
