HomeMy WebLinkAboutResolutions - No. 1601In the City Council City of Lodi Lodi, California RESOLUTION OF INTENTION NO. 1601 IN THE MATTER OF THE CONSTRUCTION OF SIDE- WALKS IN, ON AND ALONG CERTAIN PORTIONS OF CHURCH STREET, PLEASANT AVENUE, LINCOLN AVENUE, CALIFORNIA STREET, GRANT AVENUE, TURNER ROAD, PALM AVENUE, EUREKA AVENUE, LOUIE AVENUE, FALLS AVENUE, FORREST AVE- NUE, DAISY AVENUE, OLIVE COURT, FIRST STREET, HUTCHINS STREET AND LOCKEFORD STREET IN THE CITY OF LODI RESOLVED by the City Council of the City of Lodi that it is the intention of said City Council to order the following work to be done and improvements to be made in said City of Lodi, to - wit: That sidewalks be installed along and in front of all property in and along the following described portions of the following named streets and avenues: On the west side of North Church Street from the north line of Lockeford Street to the south line of Turner Road; On both sides of North Pleasant Avenue from the north line of Lockeford Street to the south line of Turner Road; On both sides of Lincoln Avenue from First Street to the south line of Turner Road; On both sides of North California Street from Lockeford Street to the south line of Turner Road; On both sides of Grant Avenue from the north line of Daisy Avenue to the south line of Turner Road; On the south side of Turner Road from the west line of Church Street to the east line of Grant Avenue; On both sides of Palm Avenue, as said street exists, between the west line of Pleasant Avenue and the east line of Grant Avenue; -1- RI 1601 - 2 On both sides of Eureka Avenue, as said avenue exists, from the west line of Church Street to the east line of Grant Avenue; On both sides of Louie Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Falls Avenue from the west line of California Street to the east line of Grant Avenue; On both sides of Forrest Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Daisy Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Olive Court between the west line of Church Street and the east line of Pleasant Avenue and be- tween the west line of Lincoln Avenue and the east line of California Street; On both designated on On both designated on On both sides of First Street as said street is the official map of Koontz Subdivision; sides of Hutchins Street as said street the official map of Kundert Suvdivision; sides of West Lockeford Street From the west 80 is so line of Church Street to the northerly continuation of the west line of Cainard Subdivision across Lockeford Street; EXCEPTING therefrom any part on which sidewalks have been installed by property owners to the line, grade and specification required by the ordinances and regulations of the City of Lodi. All of the above mentioned work is more particularly described in the plans and specifications for said work heretofore adopted by the City Council of the City of Lodi, which plans, profiles and specifications are hereby referred to for further particulars. Specific locations of the work are displayed and delineated on said plans. The specifications are those contained in Sections -2- RI 1601 - 3 2 and 10, both inclusive, of Ordinance No, 429 of the City of Lodi entitled "ADOPTING SPECIFICATIONS AND REGULATIONS FOR THE INSTAL- LATION OF CONCRETE SIDEWALKS, CURBS AND GUTTERS IN THE CITY OF LODIV BE IT FURTHER RESOLVED, that sidewalks be constructed in said streets and avenues hereinabove described at the particular locations shown on the plans and in accordance with the specifica- tions set forth in said Ordinance No. 429. That the improvements herein described shall be constructed to grades and elevations shown on the plans and profiles, which grades and elevations are hereby established as the official grades therefor. Said grades may be in part new or different from grades now existing or from existing ground levels. WHEREAS, said contemplated work and improvement, in the opinion of this City Council, is of more than local or ordinary benefit, therefore, this City Council hereby makes the costs and expenses of said work and improvement chargeable upon a district, which said district this City Council hereby declares to be the district benefitted by the work and improvement herein described; said district shall include that territory in the City of Lodi which is shown on that certain map or plat on file in the office of the City Clerk of the City of Lodi and which is entitled and described as "Map Showing Proposed Assessment District for the Improvement of North Church Street, Pleasant Avenue, Lincoln Avenue, California Street, Grant Avenue, Turner Road, Palm Avenue, Eurakg Avenue, Lour Avenue, Falb Avenue, Forrest Avenue, Deily Avenue, Olive Court, First Street, Hutchins Street and Lockeford Street in the City of Lodi". Said map by this reference is in- corporated in and made part of this resolution. Excepting from the area all publicly owned properties now in use for the perform- ance of a public function. -3- RI 1601 - 4 NOTICE IS HEREBY GIVEN THAT ON WEDNESDAY THE 16TH DAY OF MAY, 1951, AT THE HOUR OF 8:10 O'CLOCK P.M. of said day at the City Council Chambers, City Hall, Lodi, California, all persons having any objections to the said work and improvement or to the grades to which said work is proposed to be done or to the boun- daries of the district proposed to be assessed to pay the cost and expenses of said work, may appear before the City Council of the City of Lodi and show cause why said improvements should not be carried out in accordance with this Resolution of Intention, and may present written protests, not later than the hour set for hearing, against said work, the grades to which it is to be done or to the extent of the territory to be assessed to pay the costs and expenses of said work. The City Clerk of this City shall cause this Resolution of Intention to be published twice in THE LODI TIMES, a weekly news- paper of general circulation printed, published and circulated in the City of Lodi, the first publication thereof to be at least ten (10) days prior to the date herein fixed for hearing on this Resolution of Intention; The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplated work and improvement and on all open streets within the assessment district, notice of the passage of this Resolution of Intention in the time, form and manner required by law. The Gity Glerk of the Gity of Lodi la hereby directed to mail notices of the adoption of this Resolution of Intention, postage prepaid, to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for City of Lodi taxes, or as known to him; said mailing to be at least fifteen (15) days prior to the date herein fixed for the hearing on this Resolution of Intention, all in time, form and manner prescribed in said "Improvement Act of 1911". 0 -4- I, J.
