HomeMy WebLinkAboutResolutions - No. 1600In the City Council, City of Lodi Lodi, California RESOLUTION NO. 1600 RESOLUTION OF PRELIMINARY DETERMINATION THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE wRAVaMENT OF PORTIONS OF NORTH CHURCH STREP, PLEASANT AVENUE, LINC0IN AVENUE, UE, CALIFORNIA STREET, GRANT AVE UE , TURNER ROAD, PALM AVENUE, EUREKA AVENUE, LOUIE AVENUE, FALLS AVENUE, FORREST AVENUE, DAISY AVENUE, OLIVE COURT, FIRST STREET, HUTCHINS STREET AND LOOKII`0RD STREETDESCRIBING SAID PROPOSED IMPROVE- MENT MPROVE MENT AND SETTING A TIME AND PLACE OF REARING THEREON. RESOLVED, that preliminary determination is hereby made that public convenience and necessity require the following im- provements to be made and paid for by special assessments levied upon the property thereby benefitted, and that necessary proceed- ings should be taken therefore without compliance with the pro- visions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, to -wit: THAT sidewalks be installed along and in front of all property in and along the following described portions of the following named streets and avenues: On the west side of North Church.Street from the north line of inckeford Street to the south line of Turner Road; On both sides of North Pleasant Avenue from the north line of Lockeford Street to the south line of Turner Road; On both sides of Lincoln Avenue from First Street to the south line of Turner Road; • 0n both sides of North California S'tree't from Lvckeford Street to the south line of Turner Road; On both sides of Grant Avenue from the north line of Daisy Avenue and its westerly extension across Grant Avenue to the south line of Turner Road; -1- On the south side of Turner Road from the west line of Church Street to the east line of Grant Avenue; On both sides of Palm Avenue, as said Avenue exists be- tween the west line of Pleasant Avenue and the east line of Grant Avenue; On both sides of Eureka Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Louie Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Falls Avenue from the west line of Calif- ornia Street to the east line of Grant Avenue; On both sides of Forrest Avenue frim the west line of Church Street to the east line of Grant Avenue; On both sides of Daisy Avenue from the west line of Church Street to the east line of Grant Avenue; On both sides of Olive Court between the west line of Church Street and the east line of Pleasant Avenue and be- tween the west line of Lincoln Avenue and the east line of California Street; First Street as said street is so designated on the official map of Koontz Subdivision; (both sides); Hutchins Street as said street is so designated on the official wrap of Kundert Subdivision; (both sides); Lockeford Street, on both sides, from the west line of Church Street to the northerly continuation of the west line of Cainaxd Subdivision across Lockeford Street; EX 1'TING therefrom any lot, parcel or piece of ground in front or at the side of which sidewalks have been in- stalled by the owners thereof to the line, grade and specification required by the ordinances and regulations of the City of Lodi. -2 - FURTHER RESOLVED and notice is hereby given that WEDNESDAY, the 16th day of May, 1951 at 0 minutes after $ otelock P.M. and the City Council Chambers, City Hall, Lodi, California as the time and plane when and where interested persons who have filed written objections to the above improvement may appear and show cause why the City Council of the City of Lodi should not find that public convenience and necessity require the said proposed improvement without further com- pliance with the Special Assessment Investigation, Limita- tion and Majority Protest Act of 1931. THE City Clerk is hereby directed to give notice of the time and place of the bearing fixed herein in the manner required by law. This City Council hereby finds, determines and declares that the assessments for the improvement herein proposed will not exceed the limitations set forth in the Special Assessment Investigation, Limitation and Majority Protest Act of 1931. FURTHER RESOLVED and hereby ordered, that future proceedings for this proposed improvement shall be had in compliance with Improvement Act of 1911. Reference is here made to a plat or map on file in the office of the City Clerk of this City indicating by a boundary line the territory to be included in the assess- ment dx.oriet guf& to ba nonaod to pay the mats and expenses of the improvement herein provided. Specifications for this improvement shall be those con- tained in Ordinance No. 429 of the City of Lodi, entitled, ADOPTING SPECIFICATIONS AND REGULATIONS FOR TBE INST'ALIA- TION OF CONCRa"TE SIDEWATE8, CURBS AND GUTTERS IN THE CITY OF LODI particularly Sections 2 to 10 inclusive thereof -3 - which ordinance is hereby referred to and adopted as the specifications for the improvement herein proposed with the same force and effect as if set forth in full herein. 0 CERTIFIED to be a full, true and correct copy of Resolution No. 1600 as passed and adopted by the City Council of the City of Lodi in regular meeting held April 18, 1951 by the following vote: AY1'3: Councilmen, Bull, Haskell, Preszler, Ruin and Tolliver NOES: Councilmen, None ABa T:Councilmen, None, City Clerk
