HomeMy WebLinkAboutResolutions - No. 1582In the City Council City of Lodi Lodi, California RESOLUTION NO. 1582 DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF LODI TO VACATE A PORTION OF ALLEN LANE IN MORENZ TRACT. WHEREAS, Allen Lane in Morenz Tract is but a temporary street, vacation of the same having been contemplated by the San Joaquin County Planning Commission prior to the annexation of Morenz Tract to the City of Lodi at such time as James Street would be continued northerly to Lockeford Avenue or Holly Drive and, as will appear from the minutes of this City Council for April 20, 1949, and, WHEREAS, by the opening of James Street in Lakeside Park and by a certain deed from Thompson R. Moore and wife and R. M. Lipelt and wife dated December 5, 1950, conveying that part of the Northerly 13.7 feet of Lot 4, Map of Gerard Tract, James Street in Morenz Tract is now connected to James Street in said Lakeside Park thus giving access to and from interior lots in Morenz Tract and Allen Lane is no longer necessary as a public street by reason thereof, and, WHEREAS, the owners of real property abutting on said Allen Lane have petitioned. this City Council that the same be vacated, abandoned as a public street and closed up, and, WHEREAS, the City Planning Commission of the City of Lodi has approved the vacation of Allen Lane and has so reported in writing to this City Council, therefore, BE IT RESOLVED, that it is the intention of this City Council, hereby expressed, to vacate and abandon the following described portion of Allen Lane in said Morenz Tract, viz: ALLEN LANE AS SAID LANE IS DELINEATED AND SO DESIG- NATED ON THE OFFICIAL MAP OF MORENZ TRACT, FILED JUNE 25, 1947, IN VOL. 11, PAGE 151, BOOK OF MAPS AND PLATS, SAN JOAQUIN COUNTY RECORDS, EXCEPT THERE - FROM THAT FART OF SAID ALLEN LANE LYING BETWEEN THE NORTHERLY EXTENSIONS OF THE EAST AND WEST LINES OF JAMES STREET IN SAID MORENZ TRACT. Reference is here made to a map on file in the office of the City Clerk of this City delineating the portion of street herein proposed to be vacated, for further particulars and greater certainty. RESOLVED, FURTHER, that this City Council does hereby fix WEDNESDAY, JANUARY 17, 1951, at the hour of $:00 p.m. and the City Council Chambers, City Hall, Lodi, California, as the time and place when or where evidence either for or against the vacation of this part of Allen Lane will be received, heard and considered. Upon the adoption of this resolution, the Superintendent of Streets shall post, or cause to be posted, notices of such adoption and of the time and place herein set for the hearing herein provided, all in time, form, manner and number as pre- scribed by law for the vacation of public streets. The City Clerk shall cause a copy of this resolution to be published for at least two consecutive issues in The Lodi Times, a. newspaper of general circulation printed and published in the City of Lodi and hereby designated for this purpose, such publication to be completed prior to the date herein set for hearing. 0 CERTIFIED to be a full, true and correct copy of Resolution No. 15$2 of the City Council of the City of Lodi and that the same was passed and adopted in regular meeting of said City Council held December 20, 1950, by the following vote: AYES: Councilmen, RSNN, MOLL, HAMOOML,PREMMXR and TOLLI7 2 ( MAYOR ) NOES: Councilmen, NORM ABSENT: Councilmen, NO December 20, 1950 Clerk o e , of i and ex -o of the City Council of said City.
