RESOLUTION NO. 1571
A RESOLUTION PROVIDING FOR A RECREATION COMMISSION
FOR THE CITY OF LODI AND ESTABLISHING A SYSTEM OF
RECREATION FOR SAID CITY JOINTLY WITH THE LODI UNION
HIGH SCHOOL DISTRICT AND THE LODI ELEMENTARY SCHOOL
DISTRICT, AND SUPERSEDING RESOLUTION NO. 1113.
BE IT RESOLVED, by the City Council of the City of Lodi,
San Joaquin County, State of California, as follows:
1. Resolution No. 1113 of said City of Lodi is
repealed and the following substituted therefor.
2. There is hereby established in and for the City
of Lodi a commission to be known as the Recreation Commission,
which shall consist of five (5) members, each of whom shall be
appointed by the City Council and shall serve upon said Commission
for a term of four (4) years. The Commissioners appointed under
the provisions of Resolution No. 1113 and serving on said Com-
mission as of December 31, 1950, shall continue in office as
if the appointments of the said Commissioners had been made
under the provisions of this Resolution. On or before January
1, 1951, the said Commissioners shall establish by lot that
two (2) of their number shall serve for a period of two (2)
years from and after January 1, 1951, and three (3) of their
number shall serve for a period of four (4) years from and after
January 1, 1951. Their successors shall be appointed for terms
of four (4) years, or until the appointment of a qualified succes-
sor. If a vacancy shall occur otherwise than by expiration of
term, it shall be filled by appointment for the unexpired portion
of the term. No appointment made under the provisions of this
paragraph shall be effective until made by the City Council and
concurred in by the governing bodies of the Lodi Union High School
District and the Lodi Elementary School District.
3. The City Manager of the City of Lodi and the
Superintendent of Schools shall at all times act as advisers
to the Commission and, when requested by said Commission, shall
attend and advise the meetings of the said Commission.
4. Except as hereinafter specifically mentioned, the
Commission shall have all the powers contemplated by the California
Community Recreation Enabling Act of 1939, and shall have the
power to adopt by-laws, rules and regulations as necessary in
the exercise of its duties.
The Commission shall be advisory to the governing bodies
of the City of Lodi, the Lodi Union High School District and
the Lodi Elementary School District in the field of public
recreation, but shall have no administrative power or authority
to incur any indebtedness or obligation against any of the said
public authorities.
The advisory powers of the Commission shall include, but
not be limited to:
a. Recommendations as to the general nature of the
recreation program to be provided;
b. Advice and assistance to the City Recreation
Director in the preparation of his annual budget;
c. Recommendations as to the means of financing the
recreation facilities provided;
d. Study and recommendation on needed additional
recreation facilities;
e. Preparation and recommendation of a master
recreation plan;
f. Advice and assistance as requested by the local
public agencies involved.
5. The City Council shall annually make a request upon
the governing bodies of the Lodi Union High School District and
the Lodi Elementary School District for funds in such an amount
as may be deemed appropriate to supplement City funds for the
support of the recreation program. Each such request shall be
made with due regard for the budget submitted by the City Recrea-
tion Director and the advice and recommendation of the Commission.
The said District governing bodies shall consider each such re-
quest and shall authorize and pay such monies as they may deem
equitable into the City General Fund for recreation purposes.
6. Any and all agreements which may be necessary or
proper to carry out the provisions of this resolution shall be
first approved and authorized by each and all of said three (3)
governing bodies.
7. This resolution shall not be effective for any purpose
until a resolution providing for the same powers be likewise
passed and adopted by the governing bodies of the Lodi Union
High School District and the Lodi Elementary School District.
